1. Agreement Term
• Currently Two (2) 10-year terms
• Ultra agrees to Four (4) 5-year terms — at the end of each term, within 45 days an Event Report will
be placed on a Commission Agenda for consideration.
2. DCB Language
• Currently, 102dB(A) limitation measured at 60 feet from each Stage
• Ultra agrees to an additional limitation for low frequency sound of 97dB(z) with 1dB measurement
margin of error based on 1-clock hour average at specified building monitoring location; remedy:
$1,000 penalty per each non-compliance event
3. Remediation of the Park
• Currently required to remediate the park in 38 days post event
• Ultra agrees to complete remediation in 28 days. (Subject to rain days and subsequent park events)
4. Securitizing Buildings
• Ultra agrees to provide fencing for buildings immediately abutting Biscayne Blvd
• For buildings on Biscayne Boulevard starting from NE 5th Street to Biscayne Blvd Way
5. Community Meetings (2 Required)
• Ultra agrees to conduct 2 Community Meeting events 45 days prior to the event
• Organized and sponsored by City officials
6. Olympia Music School Support
• Ultra agrees to provide annual internships to Olympia Downtown Music School students
7. Closing Time Violation Penalty
• Currently $1,000 per minute of closing time violation
• Ultra agrees to $2,500 per minute of closing time violation
8. Weather Delay
• For Friday and Saturday of the Event, in the event of a weather delay the Bayfront Park Director in
consultation with the City Manager, may extend the Event for a period of the weather delay up to
one hour. On Sunday of the event, in the event of a weather delay, an extension will be granted for
the time period of the weather delay but not more than one hour.
• Extension shall be equivalent to cumulative weather delay up to maximum 1 hour to be added at end
of daily show)
9. Ferre Park — Parking
• While Ultra has not used Ferre Park Parking for past events, Ultra agrees not use Ferre Park
Parking lot for future events.

10. Dog Triangle

• Ultra agrees to provide a Dog triangle area in the Southwest corner of the Park to be open
throughout Ultra's use period for use by Downtown residents.
