A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO ACCEPT, ALLOCATE, AND APPROPRIATE GRANT FUNDS
FROM THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION
("GRANTOR") IN AN AMOUNT NOT TO EXCEED TWO HUNDRED TWENTY-
SEVEN THOUSAND, TWO HUNDRED NINETY-EIGHT AND 75/100 DOLLARS
($227,298.75) ("GRANT FUNDS") FOR PHASE II OF THE MIAMARINA PUMP -
OUT ENHANCEMENT PROJECT ("PROJECT"); FURTHER AUTHORIZING
THE ALLOCATION AND APPROPRIATION OF SEVENTY-FIVE THOUSAND,
SEVEN HUNDRED SIXTY-SIX AND 25/100 DOLLARS ($75,766.25) FROM
LEGALLY AVAILABLE FUNDING SOURCES AS THE REQUIRED CITY
MATCH; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE A GRANT AGREEMENT AND ALL RELATED DOCUMENTS,
INCLUDING ANY APPLICATIONS, AMENDMENTS, EXTENSIONS,
RENEWALS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE
CITY ATTORNEY, AND IN COMPLIANCE WITH APPLICABLE LAWS, RULES,
AND REGULATIONS; FURTHER AUTHORIZING THE CITY MANAGER TO
MAKE ANY CHANGES TO ADJUST, AMEND, AND APPROPRIATE THE
CITY'S OPERATING BUDGET, FIVE-YEAR FINANCIAL PLAN, STRATEGIC
PLAN, MULTI -YEAR CAPITAL PLAN, AND ANY OTHER NECESSARY
DOCUMENTS; FURTHER AUTHORIZING THE CITY MANAGER TO CREATE
NECESSARY ACCOUNTING STRUCTURES IN ACCORDANCE WITH
GENERALLY ACCEPTED ACCOUNTING PRINCIPLES; APPROVING,
RATIFYING, AND CONFIRMING CERTAIN NECESSARY ACTIONS BY THE
CITY MANAGER AND DESIGNATED CITY OFFICIALS TO UPDATE THE
CITY'S CAPITAL PLAN AND RELEVANT FINANCIAL CONTROLS,
ACCOUNTING ENTRIES, AND COMPUTER SYSTEMS, FOR PROJECT
CLOSE-OUTS, GRANTS AND OTHER FUNDING SOURCES IN CONNECTION
HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Miami ("City") is enhancing the pump -out system at MiaMarina at
Bayside, located at 401 Biscayne Boulevard, Miami, Florida 33132 ("Project"); and
WHEREAS, the Florida Department of Environmental Protection ("Grantor") is the lead
state agency responsible for environmental management and stewardship, including protection
of air, water, and land; and
WHEREAS, the City has been awarded a grant from Grantor for Phase II of the Project
in an amount not to exceed Two Hundred Twenty -Seven Thousand, Two Hundred Ninety -Eight
and 75/100 dollars ($227,298.75) ("Grant Funds"); and

WHEREAS, the Grantor requires that the City provide matching funds in an amount not
to exceed Seventy -Five Thousand, Seven Hundred Sixty -Six and 25/100 dollars ($75,766.25)
("City Match") for the Project; and
WHEREAS, the City has programmed funds in its Fiscal Year ("FY") 2025-2026
Operating Budget for the Project; and
WHEREAS, pursuant to Resolution No. R-25-0094, adopted March 13, 2025, the City
Commission authorized the City Manager to apply for and accept grant funds from the Florida
Inland Navigation District for the Project ("FIND Funds"); and
WHEREAS, the City wishes to accept, allocate, and appropriate the Grant Funds for the
Project and to satisfy the City Match requirements with legally available funding sources,
including, to the extent permitted, the FIND Funds, in an amount not to exceed the City Match.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to accept, allocate, and appropriate the
Grant Funds for FY 2025-2026 from the Grantor for the Project.
Section 3. The City Manager is further authorized' to allocate and appropriate the City
Match for FY 2025-2026 from the FIND Funds or other legally available funding sources, subject
to all federal, State, and local laws that regulate the use of such funds and the receipt of all
necessary approvals, including, but not limited to the City Attorney.
Section 4. The City Manager is further authorized1 to negotiate and execute a grant
agreement for the Grant with the Grantor and all other related documents, including
applications, amendments, renewals, extensions, and modifications, all in forms acceptable to
the City Attorney, for the Project.
Section 5. The City Manager is further authorized' to make any changes to adjust,
amend, and appropriate the City's Operating Budget, Five -Year Financial Plan, Strategic Plan,
Multi -Year Capital Plan, and any other documents as necessary and applicable, pursuant to the
provisions of this Resolution.
Section 6. The City Manager is further authorized1 to create the necessary accounting
structure to provide for the acceptance and expenditure of the Grant Funds in accordance with
generally accepted accounting principles.
Section 7. Certain necessary actions by the City Manager and designated City officials
and departments made in order to update the Capital Plan, relevant financial controls and
computer systems in connection therewith, for project close-outs, and for grants and other
funding sources in progress in connection herewith are ratified, approved, and confirmed.

imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.

Section 8. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
