HomeMy WebLinkAboutR-26-0185City of Miami Resolution R-26-0185 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 19147 Final Action Date: 4/23/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING, ATTACHED AND INCORPORATED AS EXHIBIT "B," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI, FLORIDA ("CITY") PURSUANT TO SECTIONS 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF FUNDS, IN THE AMOUNT OF FORTY-FIVE THOUSAND AND 00/100 DOLLARS ($45,000.00) TO SUNSHINE FOR ALL, INC., A FLORIDA NOT FOR PROFIT ORGANIZATION, FOR THE ADMINISTRATION OF CITY OF MIAMI'S SENIOR RENTAL ASSISTANCE PROGRAM ("PROGRAM"), FOR FISCAL YEAR 2025-2026, WITH AN OPTION TO PROVIDE SERVICES FOR FISCAL YEAR 2026-2027 FOR AN ADDITIONAL FORTY-FIVE THOUSAND AND 00/100 DOLLARS ($45,000.00) AT THE SOLE DISCRETION OF THE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT'S DIRECTOR OR DESIGNEE, AS SPECIFIED IN EXHIBIT "A," ATTACHED AND INCORPORATED, UTILIZING THE FUNDS GENERATED AND BUDGETED EACH YEAR FROM THE HISTORIC PRESERVATION SCHEDULES OF FEES, SUBJECT TO THE AVAILABILITY OF FUNDING; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL NECESSARY DOCUMENTS, INCLUDING AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN A FORMS ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL FEDERAL, STATE AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS, FOR SAID PURPOSE. SPONSOR(S): Commissioner Miguel Angel Gabela, Commissioner Damian Pardo, Commissioner Rolando Escalona, Commissioner Ralph "Rafael" Rosado WHEREAS, pursuant to Resolution No. R-19-0516 adopted on December 12, 2019, the City Commission authorized the establishment of a permanent Senior Rental Assistance Program ("Program") to assist eligible low-income City of Miami ("City") senior residents to mitigate rent increases; and WHEREAS, on October 12, 2023, pursuant to Resolution No. R-23-0459, the City Commission approved an amendment to the established Senior Rental Assistance program's policies and guidelines to better serve eligible seniors with low income in the community; and WHEREAS, the amendment to the established Senior Rental Assistance program included the allocation of the funds generated and budgeted each year from the Historic Preservation Schedules to be used for the administration of the Program; and City of Miami Page 1 of 3 File ID: 19147 (Revision:) Printed On: 5/5/2026 File ID: 19147 Enactment Number: R-26-0185 WHEREAS, Sunshine for All, Inc. ("Sunshine for All") is a not -for -profit 501(c)(3) organization established in December 2004 whose mission is dedicated to serving the needs of the City and Miami Dade County's vulnerable residents through the delivery and administration of social services programs to low income and at -risk segments of society; and WHEREAS, Sunshine for All has worked successfully with the City over the past ten (10) years in different projects, including relief funding for the Emergency Rental Assistance Program ("ERAP") during the Novel Coronavirus ("COVID-19") pandemic; and WHEREAS the City's Administration recommends the allocation of funds in the amount of Forty -Five Thousand and 00/100 Dollars ($45,000.00) to Sunshine for All for the administration of the City's Senior Rental Assistance program for fiscal year 2025-2026, with an option to provide services for fiscal year 2026-2027 for an additional Forty -Five Thousand and 00/100 Dollars ($45,000.00), at the sole discretion of the Department of Housing and Community Development's Director or designee, for the administration of the City's Senior Rental Assistance program as specified in Exhibit "A," attached and incorporated, utilizing the funds generated and budgeted each year from the Historic Preservation Schedules of Fees, subject to the availability of funding; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding, attached and incorporated as Exhibit "B," that competitive negotiation methods and procedures are not practicable or advantageous to the City pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended, waiving the requirements for said procedures, is ratified, approved and confirmed. Section 3. The City Manager is authorized' to allocate funds, in the amount of Forty - Five Thousand and 00/100 Dollars ($45,000.00), to Sunshine for All the administration of the City's Senior Rental Assistance program for fiscal year 2025-2026, with an option to provide services for fiscal year 2026-2027 for an additional Forty -Five Thousand and 00/100 Dollars ($45,000.00), at the sole discretion of the Department of Housing and Community Development's Director or designee, for the administration of the City's Senior Rental Assistance program as specified in Exhibit "A," attached and incorporated, utilizing the funds generated and budgeted each year from the Historic Preservation Schedules of Fees, subject to the availability of funding. Section 4. The City Manager is authorized to negotiate and execute the any and all necessary documents in forms acceptable to the City Attorney, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions.
