A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ESTABLISHING A CAPITAL PROJECT TITLED "FDEP GARBAGE TRUCK
GRANT PROGRAM"; AUTHORIZING THE CITY MANAGER TO ACCEPT A
GRANT AWARD FROM THE FLORIDA DEPARTMENT OF ENVIRONMENTAL
PROTECTION ("FDEP"), IN AN AMOUNT NOT TO EXCEED ONE MILLION
TWO HUNDRED THOUSAND AND 00/100 DOLLARS ($1,200,000.00);
APPROPRIATING SAID FUNDS TO THE GENERAL SERVICES
ADMINISTRATION DEPARTMENT ("GSA") FOR THE PURCHASE OF THREE
(3) AUTOMATED SIDE LOADER GARBAGE TRUCKS; FURTHER
ALLOCATING FUNDS FOR THE CITY OF MIAMI'S LOCAL MATCH IN AN
AMOUNT NOT TO EXCEED ONE HUNDRED FOURTEEN THOUSAND ONE
HUNDRED FIFTY-FOUR AND 20/100 DOLLARS ($114,154.20), FROM
PREVIOUSLY BUDGETED FUNDS IN CAPITAL PROJECT NO. 40-B233106;
FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE
NECESSARY DOCUMENTS TO ACCEPT THE GRANT, IN SUBSTANTIALLY
THE ATTACHED FORM; FURTHER AUTHORIZING THE CITY MANAGER OR
DESIGNEE TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER
NECESSARY DOCUMENTS, ALL IN FORMS ACCEPTABLE TO THE CITY
ATTORNEY, TO ADMINISTER AND COMPLY WITH THE REQUIREMENTS OF
THE GRANT.
WHEREAS, the City of Miami ("City") submitted a grant application ("Application") to the
Florida Department of Environmental Protection ("FDEP") for the purchase of three (3)
automated side loader garbage trucks ("Project"); and
WHEREAS, the City received approval of the Application with a grant award in an
amount not to exceed One Million Two Hundred Thousand and 00/100 Dollars ($1,200,000.00)
("Grant Funds") for the Project; and
WHEREAS, the City must provide matching funds in an amount not to exceed One
Hundred Fourteen Thousand One Hundred Fifty -Four and 20/100 Dollars ($114,154.20) ("City
Match"), to be allocated from budgeted funds in Capital Project No. 40-6233106; and
WHEREAS, as a condition of the grant award, the City must scrap three (3) class 4-7
medium trucks of model year 2009 or older;
WHEREAS, it is appropriate for the City Manager to accept the Grant Funds for the
Project, to allocate funds for the City Match from budgeted funds in Capital Project No. 40-
B233106, and to establish a capital fund for the appropriation of the Project funds;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The following new capital fund is established, and resources are appropriated
as described below:

Section 3. The City Manager is authorized1 to accept the Grant Funds, to execute the
necessary documents for the acceptance of the Grant Funds in substantially the attached form,
and to appropriate funds for the Project.
Section 4. Funds for the City Match are to be allocated from budgeted funds in Capital
Project No. 40-6233106.
Section 5. The City Manager or designee is further authorized' to negotiate and execute
any and all other necessary documents, all in forms acceptable to the City Attorney, to
administer and comply with the requirements of the grant.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City of Miami Commission.
