MUNICIPALITIES TO PASS SIMILAR RESOLUTIONS; FURTHER DIRECTING THE

A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR RON
DESANTIS AND THE MEMBERS OF THE FLORIDA LEGISLATURE TO TAKE SUCH
ACTIONS AND PASS SUCH LEGISLATION AS MAY BE NECESSARY TO
AUTHORIZE COUNTY AND LOCAL GOVERNMENTS TO USE BUILDING FUNDS TO
OFFSET GENERAL OPERATING EXPENSES; URGING COUNTIES AND OTHER
MUNICIPALITIES TO PASS SIMILAR RESOLUTIONS; FURTHER DIRECTING THE
CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE DESIGNATED
OFFICES DESCRIBED HEREIN.
WHEREAS, Florida local governments, including counties and municipalities, rely
primarily on annual levies of ad valorem taxes on the value of real property ("Property Taxes") to
fund essential public services; and
WHEREAS, the Florida House of Representatives and other state bodies have
considered proposals, including the complete elimination of Property Taxes, the effect of which
would be to eliminate the primary source of funding for county and local governments; and
WHEREAS, such actions would have a significant and detrimental fiscal impact on such
county and local governments ability to provide essential services, infrastructure, and public
safety resources to its residents and visitors; and
WHEREAS, county and local governments, like the City of Miami, charge and collect
building fees ("Building Fees"), which are intended to offset the direct costs associated with
enforcing the Florida Building Code; and
WHEREAS, under current Florida law, local governments are prohibited from using
Building Fees to offset general operating expenses unrelated to the specific service for which
the fee is charged; and
WHEREAS, authorizing county and municipal governments to use Building Fees to
supplement general revenues could, for some local governments, provide a lawful and prudent
means of offsetting reductions in ad valorem revenue resulting from the restructuring or
elimination of Property Taxes;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section
Section 2. The City Commission urges Governor Ron DeSantis and the members of the
Florida Legislature to take such actions and pass such legislation as may be necessary to
authorize county and municipal governments to use Building Fees to supplement general
revenues and to offset general operating expenses.
Section 3. The City Commission further urges counties and municipalities within the State of
Florida to adopt similar resolutions urging the Governor and the Florida Legislature to enact
such legislation.
Section 4. The City Clerk is directed to transmit a certified copy of this Resolution to:
o The Honorable Ron DeSantis, Governor of the State of Florida;
o The Honorable Ben Albritton, President of the Florida Senate;
o The Honorable Daniel Perez, Speaker of the Florida House of Representatives;
o The Honorable Daniela Levine -Cava, Mayor of Miami -Dade County;
o The Miami -Dade County Legislative Delegation;
o Mayors and Clerks of all municipalities located in Miami -Dade County;
o Clerk of the Florida Senate;
o Clerk of the Florida House of Representatives;
o Clerk of the Circuit and County Courts of Miami -Dade County;
o The Florida League of Cities;
o The Miami -Dade League of Cities; and
o All such other persons or entities as deemed proper the Mayor
Section 5. This Resolution shall become effective immediately upon its adoption.
