HomeMy WebLinkAboutPZAB (18373) ResolutionCity of Miami PZAB Resolution Enactment Number: PZAB-R-25-074 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 18373 Final Action Date: 11/5/2025 A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD ("PZAB"), RECOMMENDING TO THE MIAMI CITY COMMISSION APPROVAL OF AN ORDINANCE AMENDING ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("MIAMI 21 CODE"), BY AMENDING ARTICLE 1, TITLED "DEFINITIONS", SECTION 1.2 "DEFINITION OF TERMS" TO INTRODUCE A DEFINITION FOR "ADULT DAYCARE INDOOR ACTIVITY AREA"; BY AMENDING ARTICLE 4, TITLED "STANDARDS AND TABLES", TABLE 3 "BUILDING FUNCTION: USES" TO INCLUDE A CROSS REFERENCE TO SUPPLEMENTAL REGULATIONS AND TABLE 4 "DENSITY, INTENSITY AND PARKING" TO CLARIFY PARKING REQUIREMENTS FOR ADULT DAYCARE; AND BY AMENDING ARTICLE 6, TITLED "SUPPLEMENTAL REGULATIONS", TO ALLOW ADULT DAYCARE FACILITIES BY -RIGHT OR BY PROICESS OF WARRANT WITHIN CERTAIN SPECIFIED TRANSECT ZONES AND WHEN SPECIFIED CRITERIA ARE MET; PROVIDING FOR CRITERIA; MAKING FINDINGS; PROVIDING FOR TECHNICAL AMENDMENTS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, on October 22, 2009, the Miami City Commission adopted Ordinance No. 13114 as the Zoning Ordinance of the City of Miami, Florida, which has been amended from time to time ("Miami 21 Code"); and WHEREAS, the Office of the City Manager appointed a Steering Committee to evaluate existing Miami 21 Code entitlements with the intent of identifying opportunities for process improvements and recommending legislative amendments ("Entitlement Reform Program"); and WHEREAS, appropriately designed and located Adult Daycares provide a safe and engaging environment while receiving care and companionship; and WHEREAS, a definition of the term "Adult Daycare Indoor Activity Area" is required to ensure consistent interpretation and alignment with the intended use and function of Adult Daycare; and WHEREAS, an update is required to Article 4 "Standards and Tables"; Table 3 "Building Function: Uses" to introduce a cross reference to Article 6 "Supplemental City of Miami Page 1 of 17 File ID: 18373 (Revision:) Printed On: 11/21/2025 Regulations", Section 6.1 "Intent and Exclusions" to ensure pertinent Adult Daycare processes and criteria are administered; and WHEREAS, an update is required to Article 4 "Standards and Tables"; Table 4 "Density, Intensity and Parking" to clarify parking requirements for Adult Daycare; and WHEREAS, the introduction of a new by Right process to Article 6 "Supplemental Regulations", Section 6.1 "Intent and Exclusions" is appropriate when specified location, size, and design criteria are met; and WHEREAS, an amendment is necessary to allow Adult Daycares to "T5- R,"Urban Center Transect Zone - Restricted and "T6-R," Uban Core Transect Zone — Restricted, when specified criteria is complied with and approved by process of Warrant; and WHEREAS, the amendments streamline processes and reduce administrative redundancy while ensuring neighborhood character is preserved and impacts on Abutting properties are mitigated; and WHEREAS, the Miami Comprehensive Neighborhood Plan ("MCNP") promotes the creation of vibrant, pedestrian -friendly, and economically resilient urban environments through policies that encourage mixed -use development, active ground - floor uses, and enhancement of the public realm; and WHEREAS, consideration has been given as to whether the proposed text amendment will further the goals, objectives, and policies of the MCNP, the Miami 21 Code, and other City regulations; and WHEREAS, consideration has been given as the need and justification for the proposed text amendment, including changed or changing conditions, that make the passage of the proposed text amendment necessary; and NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted and incorporated as if fully set forth in this Section. Section 2. Adult Daycare Indoor Activity Area excludes offices, reception areas, first aid stations, kitchens, non -Habitable Spaces and Rooms, or the thickness of walls.
