WHEREAS, on October 22, 2009, the Miami City Commission adopted Ordinance No. 13114 as the Zoning Ordinance of the City of Miami, Florida, which has been amended from time to time ("Miami 21 Code"); and WHEREAS, the Office of the City Manager appointed a Steering Committee to evaluate existing Miami 21 Code entitlements with the intent of identifying opportunities for process improvements and recommending legislative amendments ("Entitlement Reform Program"); and WHEREAS, appropriately designed and located Adult Daycares provide a safe and engaging environment while receiving care and companionship; and WHEREAS, a definition of the term "Adult Daycare Indoor Activity Area" is required to ensure consistent interpretation and alignment with the intended use and function of Adult Daycares; and WHEREAS, an update is required to Article 4, titled "Standards and Tables", Table 3 "Building Function: Uses" to introduce a cross reference to Article 6, Section 6.1 of the Miami 21 Code to ensure pertinent Adult Daycare processes and criteria are administered; and WHEREAS, an update is required to Article 4, Table 4 of the Miami 21 Code to clarify parking requirements for Adult Daycares; and City of Miami File ID: 18487 (Revision: A) Printed On: 5/11/2026 WHEREAS, the introduction of a new By Right process to Article 6, Section 6.1 of the Miami 21 Code is appropriate when specified location, size, and design criteria are met; and WHEREAS, an amendment is necessary to allow Adult Daycares in "T5-R," Urban Center Transect Zone - Restricted and "T6-R," Uban Core Transect Zone — Restricted, approved by Warrant when specified criteria is complied with; and WHEREAS, the amendments streamline processes and reduce administrative redundancy while ensuring neighborhood character is preserved and impacts on Abutting properties are mitigated; and WHEREAS, the Miami Comprehensive Neighborhood Plan ("MCNP") promotes the creation of vibrant, pedestrian -friendly, and economically resilient urban environments through policies that encourage mixed -use development, active ground -floor uses, and enhancement of the public realm; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on November 5, 2025, following an advertised public hearing, adopted Resolution No. PZAB-R-25- 074 by a vote of seven to zero (7 - 0), Item No. PZAB. 9, recommending approval of this Miami 21 text change; and WHEREAS, consideration has been given as to whether the proposed text amendment will further the goals, objectives, and policies of the MCNP, the Miami 21 Code, and other City regulations; and WHEREAS, consideration has been given as the need and justification for the proposed text amendment, including changed or changing conditions, that make the passage of the proposed text amendment necessary; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted and incorporated as if fully set forth in this Section. Section 2. Article 1 of the Miami 21 Code, titled "Definitions," is hereby amended in the following particulars:1 "ARTICLE 1. DEFINITIONS 1.2 DEFINITIONS OF TERMS Adult Daycare Indoor Activity Area: A climatically controlled living room, dining room, specialized activity rooms, or other rooms to be commonly used by all Adults.
