Santana, Agenda Coordinator GKW/MCS City of Miami Legislation Resolution Enactment Number: R-26-0112 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 18906 Final Action Date:3/12/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY ATTORNEY TO PROCEED WITH LEGAL ACTION, IF NECESSARY, AGAINST CURTIS J. SMITH TO OBTAIN POSSESSION OF THE PROPERTY LOCATED AT 750 NORTHWEST 70th STREET, #3, MIAMI, FLORIDA 33150 AND SEEK ANY OTHER LEGAL REMEDIES AVAILABLE AT LAW. WHEREAS, the City of Miami ("City") owns the property located at 750 Northwest 70th Street, #3, Miami, Florida 33150 ("Property"); and WHEREAS, Curtis J. Smith ("Mr. Smith") currently resides in the Property as a month -to - month tenant; and WHEREAS, on October 29, 2025, the City delivered a notice to Mr. Smith advising that he is indebted to the City for unpaid rent and demanding payment of said rent or possession of the premises within thee (3) days; and WHEREAS, as of February 24, 2026, Mr. Smith has failed to pay any outstanding rent or vacate the Property; and WHEREAS, the City wishes to proceed with legal action, if necessary, against Mr. Smith, to obtain possession of the Property; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Attorney is authorized' to proceed with legal action, if necessary, against Curtis J. Smith to obtain possession of the Property and to seek any other available legal remedies. Section 3. This Resolution shall become effective immediately upon its adoption. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions.
