PROCESS OVERVIEW The Ad Valorem Tax Exemption is a financial incentive provided by state law (Section 196.1997 and 196.1998 Florida Statutes) and county ordinance (Section 16A-18, Miami -Dade County Code) that is intended to encourage the rehabilitation and maintenance of historic properties. The City of Miami Commission also passed an ordinance establishing a City of Miami Ad Valorem Tax Program for owners of historic properties. The Ad Valorem Tax Exemption does not give property owners total exemption from all taxes. It Is an exemption only on the amount that taxes would have increased due to the improvements made to the historic property. The exemption will only apply to those taxing authorities that agree to participate in the program (for example, the city portion or the county portion) and would not affect taxing authorities such as school districts or fire. How it Works Step 1: Preconstruction Application (Part 1) Before you begin construction All applicants must complete a Pre -construction Application which consists of two (2) sections: Determination of Property Eligibility, and a Certificate of Appropriateness that includes a detailed description of all proposed improvements and . The Preservation Office will review the application and present it before the HEPB for approval. Applicants are also responsible for applying simultaneously with the Miami -Dade County Preservation Office to take full advantage of this incentive. 1. Complete the City of Miami Ad Valorem Part I application and submit with a Certificate of Appropriateness application to be heard ata Historic and Environmental Preservation Board (HEPB) Meeting. The HEPB meets once a month on the first Tuesday of each month, except in August. 2. Complete the Miami -Dade County Part i application including a copy of all materials that were submitted to the Clty of Miami, induding a copy of the City of Miami's HEPB Resolution (application fees vary based on building use and size). 3. Send a copy of Miami -Dade County Part i application materials to the County's Office of the Property Appraiser. Step 2: Request for Review of Work (Part 2) Substantial completion of construction Once a project is substantially complete, the applicant requests a Review of Completed Work (Part 2). The Preservation Office reviews the work and the materials return to the HEPB for final approval. If everything is approved, the City and the applicant enter into a Covenant that is a promise from the property owner that they will maintain the property and the improvements for the full period of the exemption. All items are then presented to the City Commission for their consideration at a public hearing. 1. Schedule an inspection of the final work with the Preservation Office. 2. Complete the City of Miami Ad Valorem Part II application and a signed covenant (template can be obtained through the Preservation Office) to be scheduled for a Historic and Environmental Preservation Board (HEPB) Meeting. 3. Complete the Miami -Dade County Part II application including a copy of all materials that were submitted to the City of Miami, induding a copy of the City of Miami's HEPB Resolution and submit to the County's Historic Preservation Office. 4. Send a copy of Miami -Dade County Part II application materials to the County's Office of the Property Appraiser. The Property Appraiser will reassess the property and will prepare a Revenue implications Report for the OHP. After all application materials are received, the Miami -Dade County Historic Preservation Office, the application will be scheduled for a hearing in front of the County's Historic Preservation Board. In both the City of Miami and Miami -Dade County Commissions, the application will need to be scheduled for final approval. Once each respective Commission approve the application, the resolution and the covenant will need to be recorded with copies placed on file with the City of Miami's Preservation Office and the Miami -Dade County Office of Historic Preservation. The existing decorative metal column railing and wood shall be retained. If they are too deteriorated, then they shall be replaced with new but historically - designed column railing, material, and color as approved by the Historic Preservation Officer. All new proposed decorative metal railings shall be designed in a material and color as approved by the Historic Preservation Officer. 7. The Applicant shall clarify the existing and proposed heights of the roof ridges on the historic structure. Details and specifications of the proposed fence and gate along with color manufacturer's brochures and/or color photographs shall be submitted to Staff for review. 11. The material of the fence and gate shall be in keeping with the character of historic district, as determined by the Historic Preservation Officer. 12.The fence and gate on the south property line shall be set back at least one foot (1') from the front building facade. 13.The three (3) proposed Gumbo Limbo trees shall be relocated from the side of the two-story addition to the front of the historic property to provide additional screening for the large two-story volume. On June 17, 1997, the Historic and Environmental Preservation Board, pursuant to Resolution No, HEPB-97-24, designated the subject property located at 920 Northwest 9 Court as part of the Spring Garden Historic District, On July 2, 2019, the Historic and Environmental Preservation Board deferred the applicant's request for a Special Certificate of Appropriateness for demolition and new construction. Pursuant to Goal LU-2, 2.3 and 2.4 of the Miami Neighborhood Comprehensive Plan the City will preserve and protect the heritage of the City of Miami through the identification, evaluation,,. rehabilitation, adaptive reuse, restoration and public awareness of Miami's historic and archeological resources. Analysis: The applicant is proposing alterations to the existing historic structure, construction of a new rear addition, and site improvements, The proposal includes the replacement of the existing windows with "Georgian style" impact windows with muntins. The drawings do not specify if the windows are single - hung, casement, fixed, or sliding. The lighting configuration is a mixture of four -light single windows, four -light double windows, and a large window on the front elevation consisting of three four -light sections. The historic photograph appears to show casement windows of varying configurations on the front elevation, The windows visible from the right-of-way on the historic structure shall resemble the historic windows in appearance and operation, Drawings showing existing and proposed dimensions; a window schedule specifying all openings to be replaced; number key photos, floor plans, and elevations to correspond with the window schedule; dimensioned and scaled profile sections of the proposed new windows; and a color manufacturer's brochure and/or color catalogue photos of the proposed replacement windows shall be submitted for review, All glass shall be clear with the option of Low `E. The applicant is proposing to replace the existing roofing with flat dark grey concrete tiles. The tax card and the historic photograph indicate the roof was originally surfaced with cement shingles of a dark color; therefore, the proposed tiles can be supported. The drawings indicate the decorative metal and scalloped wood around the porch will be removed and replaced with a contemporary metal rail to tie in with the balcony rail on the new addition and an unspecified material, The historic photograph indicates the decorative metal and scalloped wood are original and character -defining features of the historic house. The existing decorative metal and wood shall be retained. If the Board permit their removal, details, specifications, and color manufacturer's brochures and/or color photographs of the proposed railing and materials shall be submitted for review. The existing covered terrace will be enclosed to create a laundry. This alteration can be supported as it is to the rear of the property and not visible from the right-of-way. The first application proposed raising the roof height by approximately one foot, five inches (1' 5"). The current application shows an existing and proposed top of T beam height of eight feet, seven inches (8' 7") on the existing and proposed front elevation drawings, No ridge height is provided on either drawing; however, the drawings suggest the roof height will be raised on the main building and lowered on the front projecting section, The applicant shall clarify the existing and proposed heights of the roof ridges on the historic structure. Changing the roof height is an alteration of a contributing feature and is not supported by Staff, The existing family room to the rear of the structure will be demolished to make way for the new addition. This alteration can be supported as the room is to the rear of the structure, is not visible from the right-of-way, and appears to be an enclosed porch area. Two non -original wood decks to the rear of the structure will also be demolished, Internally, the existing historic structure will be reconfigured to contain a living -dining area, two bedrooms, a bathroom, and a laundry. The car porch will not be altered. The total area of the remaining historic house will be 1,424,13 square feet. The proposed new addition to the rear of the historic structure will comprise a one-story section measuring sixteen feet, nine inches (16' 9") by forty feet (40') and a two-story section measuring twenty seven feet, eight inches (27' 8") by twenty three feet three inches (23' 3"). The two-story section will be towards the northern site boundary. The total floor area of the new addition is 1985,71 square feet. Externally, the rectangular one-story section will have a flat roof measuring twelve feet eight inches (12' 8") in height, rectangular windows on the north and south elevations, and sliding doors on the rear (west) elevation, It is not clear on the drawings if the flat roof will be visible above the pitched roof of the historic structure. The applicant shall confirm the flat roof of the one-story section of the addition will not be visible above the pitched roof of the historic structure. Adams 12/18/2019 Externally, the two-story section will have a pitched concrete tile roof measuring twenty seven feet two inches (27' 2") high. Fenestration will comprise an irregular pattern of rectangular windows on the south elevation, three rectangular windows on the north elevation, a rectangular window and door on the first floor and two rectangular windows on the second floor of the rear (west) elevation, and a large rectangular window and French doors on the second floor of the front (east) elevation, The French doors will lead to a balcony with a contemporary metal rail on the flat roof of the one-story addition, Internally, the two-story section will contain a den, a bedroom, and a bathroom on the first floor and a master bedroom, bathroom, and walk-in closet on the second floor. The Spring Garden Historic District contains a mixture of one and two-story residences; therefore, a two-story addition can be supported. In terms of massing, size, and scale, the proposed new addition is generally compatible with the historic structure. The applicant has attempted to minimize the impact of the two-story section on the historic structure by setting it back sixteen feet nine inches (16' 9") behind the one-story addition and by keeping its width significantly less than that of the historic structure. The one-story addition also helps to clearly differentiate the historic structure from the new construction, In comparison with the previous design, the second story of the addition now contains a large rectangular window on the front (east) elevation and two rectangular windows on the west elevation. There are only three windows on the north elevation of the two-story addition; however, this proposal can be supported as this appears to have been done to provide privacy to the neighbor to the north and it is unlikely the rear of this elevation will be visible from the right-of-way. Drawings showing proposed dimensions; a window and door schedule; number key photos, floor plans, and elevations to correspond with the window and door schedule; dimensioned and scaled profile sections of the proposed new windows and doors; and a color manufacturer's brochure and/or color catalogue photos of the proposed new windows and doors shall be submitted for review. All glass shall be clear with the option of Low'E'. The body of the house will be painted either Benjamin Moore Mineral White 2131-70 or Benjamin Moore Mineral Ice 2132-70 and the trim will be Benjamin Moore White Diamond 0C-61. The applicant shall clarify which paint color will be used for the body of the structure. All colors can be supported; however, the applicant may wish to consider a greater contrast in colors between the body and trim. Proposed site improvements include a new curb cut to provide driveway access, the installation of a new driveway and walkway, the installation of a new six foot (6') high Dura fence along the north, south, and west property lines, and the installation of a gate between the house and the south property line, The Materials Page suggests the driveway and walkway will be of Old Chicago brick pavers whereas the drawings indicate larger paving slabs will be installed. The applicant shall confirm which material will be used for the driveway and walkway. The Design Guidelines state brick pavers were not originally found in Miami's historic districts and 920 NW 9 Ct. File No. PZ-19-2985 Page 5 of 7 require Board approval. The applicant shall consider the installation of a paving material more consistent with the historic district. Details and specifications of the proposed fence and gate along with color manufacturer's brochures and/or color photographs shall be submitted to Staff for review. The material of the fence and gate shall be in keeping with the character of the historic district. The fence and gate on the south property line shall be set back at least one foot (1') from the front building facade. In comparison with the previous submittal, three additional Gumbo Limbos have been added along the north elevation of the two-story addition and two additional Simpson Stoppers have been added to the rear to provide screening. The Owner agrees that the City of Miami Preservation Office, their agents, and designees shall have the right to inspect the Property at all reasonable times In order to ascertain whether or not the conditions of this Covenant are being observed. 5. In the event of the non-performance or violation of the maintenance provision of the Covenant by the Owner or any successor -In -interest during the term of the Covenant, the City of Miami's Historic Preservation Office will report such violation to the Property Appraiser and Tax Collector who shall take action pursuant to 8.196.1997(7), Fla.Stat. The Owner shalt be required to timely pay the difference between the total amount of taxes which would have been due in March in each of the previous years in which the Covenant was in effect had the property not received the exemption and the total amount of taxes actually paid in those years, plus interest on the difference calculated as provided in s.212.12(3), Fla .StaL 6. If the Property is damaged by accidental or natural causes during the Covenant period, the Owner will Inform the City of Miami's Historic Preservation Office In writing of the damage to the Property, including (1) an assessment of the nature and extent of the damage; and (2) an estimate of the cost of restoration or reconstruction work necessary to retum the Property to the condition existing at the time of project completion. In order to maintain the. tax exemption, the Owner shall complete the restoration or reconstruction work necessary to retum the property to the condition existing at the time of project completion on a time schedule mutually agreed by the Owner and the City of Miami's Historic Preservation Office. 7. If the Property has been destroyed or severely damaged by accidental or natural causes, that Is, if the historical integrity of the features, materials, appearance, workmanship, and environment, or archaeological Integrity which made the property eligible for listing in the National Register of Historic Places or designation under the terms of the City of Miami's preservation ordinance have been lost or so damaged that restoration is not feasible, the Owner will promptly notify the City of Miami's Historic Preservation Office In writing of the loss no later than 10 days following the date of such loss. The City of Miami's Historic Preservation Office will evaluate the information provided and notify the Owner In writing of Its determination regarding removal of the Property from eligibility for tax exemption. If the City of Miami's Historic Preservation Office determines that the property should be removed from eligibility for tax exemption, it will notify the Miami -Dade County Property Appraiser In writing so that the tax exemption can be cancelled for the remainder of the Covenant period. In such cases, no penalty or Interest shall be assessed against the owner. 8. If it appears that the historical integrity of the features, materials, appearance. workmanship, and environment, or archaeological Integrity which made the Property eligible for listing in the National Register of Historic Places or designation under the terms of the City of MlamFs preservation ordinance have been lost or damaged deliberately or through gross negligence of the Owner, the City of Miami's Historic Preservation Office shall notify the Owner in writing. The Owner shall have 30 days to respond indicating any extenuating circumstances which show that the damage was not deliberate or due to gross negligence. If the Owner cannot show such extenuating circumstances, he shall develop a plan for restoration of the Property and a schedule for completion of the restoration. In order to maintain the tax exemption, the owner shall complete the restoration work necessary to return the property to the condition that existed at the time of project completion on a time schedule agreed upon by the owner and the City of Miami's Historic Preservation Office. If the owner does not complete the restoration work on the agreed upon time schedule, the City of Miami's Historic Preservation Office will report such violation to the Miami -Dade County Property Appraiser and Tax Collector who shall take action pursuant to s.196.1997 (7), FIa.Stat. The owner shall be required to pay the difference between the total amount of taxes that would have been due In March In each of the previous years In which the Covenant was In effect had the property not received the exemption and the total amount of taxes actually paid In those years, plus Interest on the difference calculated as provided In s.212.12(3), FIa.Stat 9.
