HomeMy WebLinkAboutR-26-0124City of Miami Resolution R-26-0124 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 18924 Final Action Date: 3/12/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S FINDINGS, ATTACHED AND INCORPORATED AS EXHIBIT "A", THAT IT IS MOST ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY") TO WAIVE THE COMPETITIVE SEALED BIDDING PROCEDURE PURSUANT TO SECTION 18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), AND RETROACTIVELY APPROVING THE SELECTION OF HARBOUR CONSTRUCTION, INC. FOR THE EMERGENCY PURCHASE OF FURNISH AND INSTALL SERVICES TO RETRO-FIT SHOWER PANS IN ALL THE MEN AND WOMEN'S SHOWER STALLS AT THE POLICE COLLEGE, LOCATED AT 400 NORTHWEST 2 AVENUE, MIAMI, FLORIDA, 33128 TO PREVENT WATER DRAINING IN THE HALLWAYS, FURTHER DAMAGING CITY PROPERTY, FOR THE AMOUNT OF SEVENTY-TWO THOUSAND AND 00/100 DOLLARS ($72,000.00); ALLOCATING FUNDS FROM THE POLICE DEPARTMENT GENERAL ACCOUNT CODE FUND 00001.191508.546000; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, AND COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING, THE CITY OF MIAMI'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. SPONSOR(S): Commissioner Christine King WHEREAS, on August 20, 2025, water from the men and women's shower stalls was draining into the hallways at the Police College, located at 400 Northwest 2 Avenue, Miami, Florida 33128 ("Police College"), disrupted the use of the showers, and threatened further damage to City property; and WHEREAS, Harbour Construction, Inc.("Contractor") has offered to provide furnish and installation services to retro-fit shower pans in all the men and women's shower stalls at the Police College ("Services") for an amount not to exceed Seventy -Two Thousand and 00/100 Dollars ($72,000.00) to prevent further water draining in the hallways and further damage to City property; and WHEREAS, the City Manager pursuant to Section 18-90 of the Code of the City of Miami, Florida, as amended ("City Code"), made a written finding, attached and incorporated as Exhibit "A" ("City Manager's Findings"), that an emergency exists and approved an emergency City of Miami Page 1 of 2 File ID: 18924 (Revision: A) Printed On: 3/31/2026 File ID: 18924 Enactment Number: R-26-0124 purchase request by the City of Miami ("City") Police Department of the Services from Contractor to prevent further harm to City property; and WHEREAS, the City Commission desires to ratify, confirm, and approve, the City Manager's Findings and retroactively authorize the City Manager to execute an agreement with Contractor to protect the life, health, welfare and convenience of the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, the City Commission hereby ratifies, approves, and confirms the City Manager's Findings, that it is most advantageous for the City to waive the competitive sealed bidding procedures, pursuant to Section 18-90 of the City Code and retroactively approving the selection of Contractor for the emergency purchase of the Services for an amount of Seventy -Two Thousand and 00/100 Dollars ($72,000.00). Section 3. Funds for this purpose shall be allocated from the Police Department General Account Code No. 00001.191508.546000. Section 4. The City Manager is authorized' to negotiate and execute any and all documents, all in forms acceptable to the City Attorney, subject to all allocations, appropriations, prior budgetary approvals, and compliance with applicable provisions of the City Code, including, the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, all in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: rge = .
