HomeMy WebLinkAboutR-26-0133City of Miami Resolution R-26-0133 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 18996 Final Action Date: 3/12/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION ISSUING A NOISE WAIVER PURSUANT TO SECTIONS 36-4(A) AND (C) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TITLED "OPERATION OF RADIOS, PHONOGRAPHS OR OTHER SOUND -MAKING DEVICES; BANDS, ORCHESTRAS AND MUSICIANS —GENERALLY; EXEMPTION," AND SECTION 36-5(A) AND (C) OF THE CITY CODE, TITLED "SAME — HOURS OF OPERATION OF JUKEBOXES, RADIOS, ETC.; EXEMPTION FOR EVENT ON CITY -OWNED PROPERTIES; RELAXATION," FOR A MIAMI MUSIC WEEK EVENT FROM MARCH 26, 2026, THROUGH MARCH 28, 2026, AND FOR A FORMULA 1 EVENT FROM APRIL 30, 2026, THROUGH MAY 2, 2026, FOR THE PROPERTY LOCATED AT 300 NORTHEAST 71 STREET, MIAMI, FLORIDA. SPONSOR(S): Commissioner Christine King WHEREAS, Little River Studios ("Event Holder") is located at 300 Northeast 71 Street, Miami, Florida ("Event Site"); and WHEREAS, Miami Music Week is a yearly event occurring in March 2026 and will attract people from all over the world to South Florida; and WHEREAS, Formula 1 Grand Prix will once again be holding its annual races and events at the beginning of May 2026, which also brings people from all over the world to South Florida; and WHEREAS, the Event Holder has events for both the Miami Music Week and Formula 1 race week; and WHEREAS, Section 36-4(a) of the Code of the City of Miami, Florida, as amended ("City Code"), prohibits excessive noise or music audible at a distance of one hundred (100) feet from a building or structure or vehicles from where it is produced; and WHEREAS, Section 36-4(c)(1) of the City Code provides that the City Commission may declare an exemption from Section 36-4(a) for special occasions by Resolution; and WHEREAS, Section 36-5(a) of the City Code limits noise disturbances to those in repose from the hours of 11:00 pm to 7:00 am; and WHEREAS, Section 36-5(c) of the City Code provides that the City Commission may declare an exemption from section 36-5(a) of the City Code for special occasions by Resolution; and City of Miami Page 1 of 2 File ID: 18996 (Revision:) Printed On: 3/19/2026 File ID: 18996 Enactment Number: R-26-0133 WHEREAS, all other requirements of the City Code such as building, special event permitting and other code matters are still required to be met; and WHEREAS, the cutoff time for each Event at the Event Site is 3:00 am the following morning; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The noise prohibition contained in Section 36-4(a) of the City Code is waived pursuant to Section 36-4(c)(1) of the City Code entitled "Operation of radios, phonographs or other sound -making devices; bands, orchestras and musicians —Generally; exemption" for: 1. Miami Music Week Events at the Event Site from March 26, 2026, through March 28, 2026. 2. Formula 1 Grand Prix Events at the Event Site from April 30, 2026, through May 2, 2026. Section 3. The noise prohibition contained in Section 36-5(a) of the City Code is waived pursuant to Section 36-5(b) of the City Code entitled "Same — Hours of operation of jukeboxes, radios, etc.; exemption for events of City -owned property; relaxation " for: 1. Miami Music Week Events at the Event Site from March 26, 2026, through March 28, 2026. 2. Formula 1 Grand Prix Events at the Event Site from April 30, 2026, through May 2, 2026. Section 4. The Event Site and Event Holder must comply with all other requirements of the State, Local and City law including building and special event permitting. Section 5. The Event at the Event Site shall end at 3:00 am the following morning. Section 6. Any violation of this Waiver or the requirement of State, local, and City law shall result in a revocation of any permitting issued and cancellation of the Event. Section 7. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: rge = .
