A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN
INTERGOVERNMENTAL AGREEMENT, BETWEEN THE CITY OF MIAMI
("CITY") AND MIAMI-DADE COUNTY ("COUNTY"), ATTACHED AND
INCORPORATED AS EXHIBIT "A," TO ALLOW THE INSTALLATION AND
MAINTENANCE BY THE CITY OF MIAMI ("CITY") OF DECORATIVE
STREETLIGHTS WITHIN CITY -OWNED RIGHT-OF-WAY TO BE PARTIALLY
FUNDED BY MIAMI-DADE COUNTY LOCATED ON BRICKELL AVENUE AND
SOUTHEAST 14 TERRACE.
WHEREAS, the City of Miami ("City") and Miami -Dade County ("County") wish to add a
new traffic signal device at the intersection of Brickell Avenue and Southeast 14t" Terrace in
accordance with the Intergovernmental Agreement, in substantially the form attached and
incorporated herein as Exhibit "A"; and
WHEREAS, Brickell Avenue and Southeast 14t" Terrace are municipal roads maintained
by the City; and
WHEREAS, street lighting is required as part of the new traffic signal design based on
County standards; and
WHEREAS, the County has a proposed signal project at the intersection, and while it
normally does not fund street lighting on municipal roads, it agreed to partially fund the street
lighting as part of such proposed project; and
WHEREAS, the City wishes to enhance the aesthetics within the City's limits; and
WHEREAS, the City and County herein wish to facilitate the implementation of street
lighting within the right-of-way of the intersection of Brickell Avenue and Southeast 14t" Terrace,
hereinafter referred to as the "Project"; and
WHEREAS, the Project scope consists of the installation of a new traffic signal, new
decorative street lights at the intersection, and upgrade of existing street light fixtures at the
intersection of Brickell Avenue and Southeast 14th Terrace consisting of two (2) new street light
poles and fixtures, and upgrading of four (4) existing street lights along Brickell Avenue with new
fixtures as per Exhibit "B," attached and incorporated herein by reference; and
WHEREAS, the City agrees to fund the excess differential between the County's
standard streetlights and the City's requested decorative street lights; and
WHEREAS, the City agrees to install, upgrade, and maintain, the decorative streetlights
through their existing lighting maintenance contract agreement; and

WHEREAS, the County will pay the City to install two (2) new street light poles and
fixtures and to upgrade four (4) existing street light poles with new fixtures and the City agrees
to fund the excess differential between the County's standard streetlights and the City's
requested decorative streetlights; and
WHEREAS, the estimated total cost for the decorative lighting improvement is One
Hundred Nine Thousand, Eighty -Nine and 00/100 Dollars ($109,089.00), of which the County
will fund Eighty -Nine Thousand, Three Hundred Seventy -Six and 00/100 Dollars ($89,376.00),
the City will fund a minimum of Nineteen Thousand, Seven Hundred Thirteen and 00/100
Dollars ($19,713.00), and the City will be solely responsible for any overages; and
WHEREAS, the City shall, at its sole cost and expense, maintain, repair, and replace, as
necessary, the proposed decorative streetlight system in a like manner to that of the streetlights
currently existing along Brickell Avenue;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The Recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby approves the Intergovernmental Agreement,
between the City and the County, to allow installation by the City streetlights within city -owned
right-of-way to be partially funded by Miami -Dade County located on Brickell Avenue and
Southeast 14t" Terrace.
Section 3. The City Manager is authorized' to negotiate and execute the
Intergovernmental Agreement, in substantially the form attached and incorporated as Exhibit
"A.

Section 4. The City Manager is further authorized to execute any amendments,
extensions, renewals, or related documents necessary to implement the intent of this
Resolution, in a form acceptable to the City Attorney.
Section 5. This Resolution shall become effective immediately upon its adoption.
APPROVED AS TO FORM AND CORRECTNESS:
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
