Subject: Review/Approve - Current Inventory City -Owned Lands
Purpose of Item:
AUTHORIZING THE CITY MANAGER TO REVIEW AND APPROVE THE CURRENT
INVENTORY OF CITY -OWNED LANDS SUITABLE FOR AFFORDABLE HOUSING,
PURSUANT TO SECTION 125.379, FLORIDA STATUTE, PROVIDING FOR THE
UPDATING OF SAID INVENTORY.
Background of Item:
In March 2023, Governor Ron DeSantis signed into law Senate Bill ("Live Local Act" or
the "Act") that supports the development of affordable housing by expanding and
creating affordable housing programs.
The Act among its provisions, Section 125.379 of the Florida Statutes, which permits
the conveyance of property owned by Florida counties to private developers for the
purpose of developing affordable housing, was revised by the Act to encourage more
development pursuant to that statute.
The Act also makes conforming changes to Section 166.0451, Florida Statutes,
together with Section 125.379, which provides the same power to municipalities in
Florida.
The Statutes permit counties and municipalities to sell or lease property for the
development of affordable housing without a competitive process.
The Act requires every municipality and county to prepare an inventory of all real
property within its jurisdiction to which it holds fee simple title that is appropriate for use
as affordable housing.
The City of Miami is committed to addressing the need for affordable housing and
ensuring that public lands are utilized to their highest and best for the community.
The inventory list attached as Exhibit "A," is the current list of all available City -owned
lands suitable for affordable housing in accordance with Section 125.379, Florida
Statutes.
The inventory list and the eligibility criteria will be reviewed every 3 years by the city
commission as required under FS 125.379.
The City's Administration recommends the review and approve the current inventory of
City -owned lands suitable for affordable housing, pursuant to Section 125.379, Florida
Statute, as described in Exhibit "A", attached and incorporated, for the disposition of
City -owned to create permanent supply of affordable housing for low- and moderate -
income households.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO APPROVE THE CURRENT INVENTORY
OF CITY OF MIAMI OWNED REAL PROPERTY APPROPRIATE FOR AFFORDABLE
HOUSING, PURSUANT TO SECTION 166.0451, FLORIDA STATUTES, AS MORE
PARTICULARLY SPECIFIED IN EXHIBIT "A," ATTACHED AND INCORPORATED.
WHEREAS, in March 2023, Governor Ron DeSantis signed into law Senate Bill ("Live
Local Act" or the "Act") that supports the development of affordable housing by expanding and
creating affordable housing programs; and
WHEREAS, the City of Miami ("City") is committed to addressing the need for affordable
housing and ensuring that public lands are utilized to their highest and best for the community;
and
WHEREAS, Section 166.0451, Florida Statutes requires every municipality to prepare
an inventory of all real property within its jurisdiction to which it holds fee simple title that is
appropriate for use as affordable housing; and
WHEREAS, Section 166.0451, Florida Statutes further provides that the governing body
of the municipality must review the inventory list at a public hearing, adopt a resolution
establishing the inventory list, and publish the list on its website; and
WHEREAS, the inventory list attached and incorporated as Exhibit "A," is the current list
of all available City -owned real property suitable for affordable housing in accordance with
Section 166.0451, Florida Statutes; and
WHEREAS, the City's Administration recommends the approval of the current inventory
of City -owned real property suitable for affordable housing, pursuant to Section 166.0451,
Florida Statutes, as described in Exhibit "A," attached and incorporated, for the disposition of
City -owned real property appropriate for affordable housing;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorized1 to approve the current inventory of
City -owned real property appropriate for affordable housing in accordance with Section
166.0451, Florida Statutes, and to cause such approved inventory to be published and
maintained on the City's website located at www.miami.gov/My-
Government/Departments/Housing-Comm unity-Development/I nventory-List-Live-Local-Act.
Section 3. This Resolution shall become effective immediately upon its adoption.
