Background of Item: The City of Miami ("City") is the fee simple owner of that certain portion of property identified by Folio number 01-3132-000-0090, containing approximately Fifteen Thousand, Six Hundred and Nine (15,609) square feet, and legally described in Exhibit "A," attached and incorporated ("Parcel"). The Florida Department of Transportation ("FDOT") has requested that the City dedicate the Parcel to FDOT for right-of-way purposes pursuant to Florida Statutes and the FDOT procedures for acquiring rights -of - way from local governmental agencies ("Dedication"). The Dedication shall be granted to implement a project of a governmental agency or instrumentality in accordance with Section 29-B(c) of the Charter of the City of Miami, Florida, as amended. If the Parcel or any portion thereof ceases to be used for right-of-way purposes, all rights and title to the Parcel, or the disused portion thereof, shall revert to the City automatically. WHEREAS, the City of Miami ("City") is the fee simple owner of that certain portion of property located generally at 1550 NW 37 Avenue, Miami, Florida and identified by Folio number 01-3132-000-0090, containing approximately Fifteen Thousand, Six Hundred and Nine (15,609) square feet, and legally described in Exhibit "A," attached and incorporated ("Parcel"); and WHEREAS, the Florida Department of Transportation ("FDOT") has requested that the City dedicate the Parcel to FDOT for right-of-way purposes pursuant to Florida Statutes and the FDOT procedures for acquiring rights -of -way from local governmental agencies ("Dedication"); and WHEREAS, the Dedication shall be granted to implement a project of a governmental agency or instrumentality in accordance with Section 29-B(c) of the Charter of the City of Miami, Florida, as amended; and WHEREAS, if the Parcel or any portion thereof ceases to be used for right-of-way purposes, all rights and title to the Parcel, or the disused portion thereof, shall revert to the City automatically; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Pursuant to Section 29-B(c) of the City Charter, the City Commission hereby approves the Dedication of the Parcel to the FDOT for right-of-way purposes. Section 3. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
