Background of Item: The U.S. Department of Housing and Urban Development administers Community Project Funds made available by Congress annually in a Consolidated Appropriations Act. In 2024 Public Laws 118-42 and 118-47 designated $3,290,054,336 for Community Project Funding. $1,000,000.00 of the CPF has been earmarked for the City of Miami to construct the Little Haiti Youth Center at Athalie Range Park. The recreational building is conceptually designed to be an ADA compliant 12,000 square feet gathering place for local youth and residents. The facility will include a 3,000 square foot computer lab, arts and crafts room and indoor fitness area with exercise equipment and lockers providing the community a safe place to thrive. This resolution authorizes the City manager to accept, budget, allocate and appropriate the CPF funds pursuant to an agreement negotiated and executed by the City Manager in a form acceptable to the City Attorney to construct the Little Haiti Youth Center at Athalie Range Park. WHEREAS, on March 9, 2024, President Joseph R. Biden signed House Resolution ("H.R.") 4366, the Consolidated Appropriations Act, 2024 Public Law 118-42 into law ("P.L. 118- 42"); and WHEREAS, on March 23, 2024, President Joseph R. Biden signed H.R. 2882 the Further Consolidated Appropriations Act, 2024 Public Law ("P.L.") 118-47 into law; and WHEREAS, the United States Congress through P.L. 118-42 and P.L. 118-47 appropriated One Million and 00/100 Dollars ($1,000,000.00) from the Community Project Fund administered by the Department of Housing and Urban Development to the City of Miami ("City") for the construction of a new recreation building for Athalie Range Park; and WHEREAS, the City Commission finds it is in the best interest of the City to accept, budget, allocate, and appropriate the funds appropriated to it in P.L. 118-42 and P.L. 118-47 and to authorize the City Manager to negotiate and execute any and all agreements and other necessary related documents with the federal government, all in forms acceptable to the City Attorney, to implement the acceptance, administration, and use of the funds appropriated to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to accept, budget, allocate, and appropriate the One Million and 00/100 Dollars ($1,000,000.00) to the City for the construction of a new recreation building in Athalie Range Park. Section 3. The City Manager is further authorized' to negotiate and execute agreements with the Federal government, all in a form acceptable to the City Attorney, to implement the acceptance, administration, and use of the Federal Appropriated Funds. Section 4. The City Manager is further authorized1 to negotiate and execute any and all other necessary documents, including, but not limited to, amendments, extensions, renewals and modifications, all in forms acceptable to the City Attorney, for acceptance, implementation of, and compliance with the agreements for the Federal Appropriated Funds. Section 5. Certain necessary actions by the City Manager and designated City officials and departments made in order to update the City's Operating Budget, Capital Plan, relevant financial controls and computer systems in connection therewith, for project close-outs, and for grants and other funding sources in progress in connection herewith are ratified, approved, and confirmed. Section 6. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission
