WHEREAS, Section 19-7(c)(2) of the Code of the City of Miami, Florida, as amended ("City Code"), prohibits permits for fireworks between the hours of 9:30 P.M. and 9:00 A.M. Sunday through Thursday and the hours of 11:00 P.M. and 9:00 A.M. Friday through Saturday; and WHEREAS, Section 19-7(c)(4) of the City Code provides that the City Commission may relax the restrictions contained in Section 19-7(c)(2) or declare them inapplicable on special occasions; and WHEREAS, the Mandarin Oriental Hotel is scheduled to be imploded/demolished on April 12, 2026, ("Event"), with a start time of 8:30 A.M., on Brickell Key, Miami, Florida; and WHEREAS, as part of the implosion/demolition the Contractor wishes to provide a fireworks display to mark the occasion; and WHEREAS, it is expected that the implosion/demolition is expected to commence prior to 9:00 A.M. during a firework display prohibition timeframe and therefore in need of a waiver of the City Commission; and WHEREAS, the City Commission wishes to waive the restrictions of Section 19-7(c)(2) pursuant to Section 19-7(c)(4) from 8:00 A.M. to 9:00 A.M. on April 12, 2026, dependent on the commencement of the implosion/demolition; and WHEREAS, in accordance with Section 2-33(f) of the City Code, the City Commission, by a majority vote, hereby deems this Resolution to be of an emergency nature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. A fireworks display waiver pursuant to Section 19-7 of the City Code, titled "Manufacture, sale, time of display and discharge of fireworks," is issued, for the fireworks display in connection with the implosion/demolition of the Mandarin Oriental Hotel on Brickell Key, Miami, Florida on April 12, 2026. Section 3. This Resolution does not waive any other requirements of the City Code, including but not limited to, noise restrictions, applicable fees, inspections, and permits. Section 4. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS:
