APPLICANT(S): James Reyes, City Manager, on behalf of the City of Miami
PURPOSE: The request seeks approval to amend Miami 21 Zoning Code Text Amendments for
the Appendix P — Wynwood Norte NRD-2. Proposed targeted interventions to promote small
scale commercial buildings along Wynwood Norte Main Street and Wynwood Norte Corridors,
make adjustments to benefit height in T4 and T5 Transect Zones, and setbacks along Wynwood
Norte Thoroughfares above eight stories consistent with text amendments recently adopted for
other NRDs in City of Miami, and remove master sign plan requirement for structures with
multiple commercial or office tenants.

CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on October 22, 2009, the Miami City Commission adopted Ordinance No.
13114, the Zoning Ordinance of the City of Miami, Florida, which has been amended from time
to time ("Miami 21 Code"); and
WHEREAS, on March 25, 2021, Ordinance No. 13987 amended the Miami 21 Code to
include Appendix P: Wynwood Norte Neighborhood Revitalization District ("NRD-2"), which has
been amended under Ordinance No. 14242 to implement the Wynwood Norte Community
Vision Plan, and Ordinance No. 14365 to update demolition, parking, and design standards; and
WHEREAS, Dominant Setback Waivers allow new developments to match the existing
pattern of mature buildings on a block, encouraging infill development that promotes pedestrian
activity compatible with the traditional scale and commercial character along Northwest 2nd
Avenue, Northwest 36th Street, and Northwest 29th Street in Wynwood Norte; and
WHEREAS, an amendment to Appendix P of the Miami 21 Code is necessary to update
design requirements for master sign plans for structures containing multiple commercial or office
tenants to promote high -quality signage for businesses, attract customers, and create
pedestrian -friendly streetscapes; and

WHEREAS, the Wynwood Norte Public Benefits Program allows bonus Building Height
in exchange for developer contribution to specified programs that provide benefits to the public
within the NRD-2 boundaries; and
WHEREAS, benefit height regulations allow additional capacity for mid -rise housing that
promotes affordability by providing a range of cost-effective building typologies; and
WHEREAS, to support the continued evolution of the Wynwood Norte Neighborhood,
the amendments provide additional NRD-2 setback requirements for Wynwood Norte NRD-2
Corridors and Thoroughfares; and
WHEREAS, this Miami 21 Code text amendment supports the Miami Comprehensive
Neighborhood Plan ("MCNP") Land Use Policy LU-1.3.14 to continue to enforce urban design
guidelines for public and private projects which shall be consistent with neighborhood character,
history, and function, and shall be in accordance with the neighborhood design and
development standards adopted as a result of the amendments to the City's land development
regulations and other initiatives; and
WHEREAS, the Wynwood Community Enhancement Association, during a Board
meeting on July 15, 2025, recommended approval of the proposed amendments to Appendix P;
and
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on
January 21, 2026, following an advertised public hearing, adopted Resolution No. PZAB-R-26-
004 by a vote of seven to zero (7 - 0), Item No. PZAB. 8, recommending approval of the Zoning
Text Change; and
WHEREAS, consideration has been given to the Planning Director's recommendations,
and a public hearing was held on the proposed amendments; and
WHEREAS, consideration has been given to the need and justification for the proposed
change, including changed or changing conditions that make the passage of the proposed
change necessary; and
WHEREAS, consideration has been given to the relationship of this proposed
amendment to the goals, objectives and policies of the MCNP, with appropriate consideration as
to whether the proposed change will further the goals, objectives, and policies of the MCNP; the
Miami 21 Code; and other City regulations; and
WHEREAS, the City, after review, finds this amendment to the Miami 21 Code
necessary and appropriate;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted and incorporated as if fully set forth in this Section.
Section 2. Appendix P: Wynwood Norte NRD-2 of the Miami 21 Code, is hereby
amended in the following particulars:1

SECTION 3 — GENERAL TO ZONES
3.2 THOROUGHFARES
3.2.1 NRD-2 Thoroughfares and Corridors
The District is demarcated, traversed, or connected by important Thoroughfares and Corridors
that provide opportunities for future Development. Wynwood Norte Corridors have potential to
increase Development Capacity for a mix of residential and non-residential Uses, provide ideal
locations for increased Building Height, and promote higher Commercial Use activities to
support economic development and enhanced connectivity and to service the residential
community in the interior of the Neighborhood.
a. Improvements and new Development along Wynwood Norte Thoroughfares and
Corridors within the NRD-2 boundaries shall conform to the following pedestrian safety
and comfort standards unless otherwise specified herein:
1. A Dominant Setback Waiver shall not may be permitted granted in order for new
Developments to establish a uniform streetscape with sidewalk conditions that
promote pedestrian activity, except for a when one or more of the following
conditions apply:
i. For frontages on a Wynwood Norte Main Street or Wynwood Norte
Corridors where the Development is two -stories in height or less in height,
or
ii. Where more than 50% of the subject Block Frontage demonstrates a
clearly established setback, the Development incorporates Educational,
Religious, Civic, Civil Support Use, Art Gallery, or Micro -Retail Use on the
ground floor, and approval of a Dominant Setback Waiver will enhance
the quality of the pedestrian environment.
The Dominant Setback Waiver shall be limited to the first two (2) Stories only.

3.3 WYNWOOD NORTE PUBLIC BENEFITS PROGRAM

c. Bonus Building Height shall be permitted if the proposed Development contributes
toward the specified public benefits, above that which is otherwise required by the NRD-
2, in the amount and in the manner set forth herein.
1. T4-R: three (3) Story maximum, bonus to four (4) Stories; the additional floor of
Development Height shall only be permitted by providing at least 10% of the
residential units as 2-bedroom units priced at or below 80% of Area Median
Income and 10% of the residential units as 2-bedroom units priced at or below
100% of Area Median Income.
2. T5 L: five (5) Story maximum, bonus to six (6) Stories; the additional floor of
Development Height shall only be permitted through Public Benefits for
Affordable/Workforce Housing, Public Parks and Open Space, Civic Space Type,
Civil Support Use, Micro Retail/Startup Space, and/or cash contributions to the
Wynwood Norte Public Benefits Trust Fund. Additional bonus Height, if
applicablc, may be achicvcd through Public Benefits or through the Wynwood
Norte TDR Program.

3, 2. T5-9-: five (5) Story maximum, bonus to eight (8) Stories; the first additional
floor of Development Height shall only be permitted through Public Benefits for

Wynwood Norte Public Benefits Trust Fund. Additional bonus Height may be

SECTION 7 — SIGN REGULATIONS
7.1 NRD-2 SIGN STANDARDS
a. The following Sign standards shall apply within NRD-2 for T5 and T6 Transect Zones.
1. For new structures with multiple Commercial or Office tenants, the owner of the
property shall develop a master sign plan shall be required to integrate signage
with the architectural elements of the building, standardize the app rance of the
signage for ach space and reduce visual clutter, and reflect the character of the
neighborhood. The master sign plan shall be approved by the Planning Director,
or designee, which shall be approved prior to issuance of a Certificate of Use.
A master sign plan shall include graphic depiction of general location and design
of Business Identification Signs on Building Facades., with minimum and
maximum surface area dimensions, standard fonts and typeface;_ signs Signage
shall utilize standardized design elements, colors, materials,_and minimum and
maximum surface area dimensions and fonts that contribute to the character of
the neighborhood.
2. Menu Board Signs shall be prohibited.
3. Business Identification Signs for Micro Retail Uses on Wynwood Norte Main
Street may deviate up to 10% from typical Sign Design Standards in Article 10,
Table 15, by Waiver.
4. All other Building Identification and Business Identification Signs shall be subject
to Article 10, Table 15 Sign Design Standards
SECTION 9 — STREET MASTER PLAN
9.1 NRD-2 STREET MASTER PLAN
a. NRD-2 Street Hierarchy and Setbacks
The NRD-2 Street Master Plan acknowledges the relative importance of several
significant thoroughfares within the NRD-2 boundaries, known as Wynwood Norte
Boulevard, Wynwood Norte Main Street and the Wynwood Norte Corridors. Due to their
importance and differences in function and character of street section and adjacent
uses, these Corridors are given established setback provisions that are different from
that of the underlying Transect Zone.
The table below establishes minimum Principal and Secondary Front Setback standards.
All side and rear setback standards are set forth in Illustration 5.1, 5.2, and 5.3. For
purposes of setbacks within the NRD-2 boundaries, Alleys shall not be treated as

Thoroughfares. Lots abutting Alleys shall have rear and side setbacks assigned based
on Illustration 5.1.

Section 3. It is the intention that the provisions of this Ordinance shall become and be
made a part of the Zoning Ordinance of the City of Miami, Florida, which provisions may be
renumbered or realtered and that the word "ordinance" may be changed to "section," "article," or
other appropriate word to accomplish such intention.
Section 4. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective ten (10) days upon adoption.2
