BY REPEALING RULE VII/ PART Ir SECTION 2, SUBSECTION (b), AND SUBSTITUTING THEREFOR A NEW SUBSECTION(b), CLARIFYING THAT THE WRITTEN REQUEST FOR REMOVAL FROM AN ELIGIBLE REGISTER MUST COME FROM THE APPLI- CANT; BY REPEALING RULE VII, PART II, SECTION 3, SUBSECTION (b), AND SUBSTITUTING THEREFOR A.NEtniSUBSECTION (b), CLARIFYING THAT THE WRITTEN REQUEST FOR REMOVAL FROM AN ELIGIBLE PROMOTIONAL, REGISTER MUST COME FROM THE SUBJECT EMPLOYEE; EY DELETING RULE VII, PART IIr SECTION 3, SUBSECTION (e) IN ITS ENTIRETY SINCE MEDICAL EXAMINA- TIONS ARE NOT REQUIRED FOR TRUE PROMOTIONAL POSITIONS.' WHEREAS,the Civil Service Board, at its special meeting of August 13, 1974, proposed an amendment to Rule VII, Part I► Section 3, Subsection (b) and Part II, Section 3, Subsections (b) and (e) by substituting therefor new Subsection (b) of Section 3, Part I"and Subsection (b) of Section 3, Part II and deleting Subsection (e) of Section 3, Part II as set forth in Sections 1, 2 and 3 herein; and WHEREAS, the Civil Service Board, at the regular meeting of September 17, 1974, voted to adopt the changes in Rule ViI as set forth in Sections 1, 2 and 3.herein, and WHEREAS, it is the desire of this body to incorporate theseprovisions in the Civil'Service Rules and Regulations of the City. of Miami;. NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF. THE CITY OF MIAMI, FLORIDA. Section 1. Section 3. That Ordinance No. 6945,,passed and adopted by the City Commission of the City of Miami, Florida on November 15, 1961, being an Ordinance approving the Civil Service Rules and Regulations of the City of Miami, is hereby amended by deleting Subsection (e) of Section 3, Part II, Rule VII'in its entirety. Section 4. All ordinances, code sections or parts thereof in conflict are hereby repealed. Section 5. If any section, subsection, clause or provision of this amendment is held invalid, the remainder of this ordinance shall not be affected by such invalidity.
