TWELVE (1 2) MONTHS . OR FAILED THE SAME OR LIKE EXAMINATION WITHIN THE; LAST SIX (6) MONTHS OR HAD AN UNSATISFACTORY EFFICIENCY EVALUATION ON THE PRECEDING RATING PERIOD SHALL NOT BE ELIGIBLE TO PARTICIPATE IN PROMOTIONAL "EXAMINATIONS; PROVIDING FOR WAIVER; BY REPEALING RULE VI, PART III, SECTION 1, SUBSECTION (e), and SUBSTITUTING THEREFOR.A NEW SUBSECTION (e), WHICH EXTENDS TO THE DEPARTMENT OFFICIAL FILLING A VACANCY THE RIGHT TO EXAMINE THE RESULTS OP AN APPLICANT'S EXAMINATION IN ORDER TO CONFORM THIS RULE WITH, RULE VIII, SECTION 13; BY REPEALING RULE VI, PART III, SECTION 3, AND SUBSTITUTING THEREFOR A NEW SECTION 3 WHICH, MAKES THE RULE REFLECT THE CURRENT STATE LAW REGARDING VETERAN'S PREFERENCE. WHEREAS, the Civil Service Board,at its special meeting of. August 13, 1974, proposed an amendment to Rule VI, part II, Section 2, Paragraph.2 and Part III, Section 1, Subsection (e) and Section 3 by substituting therefor a new paragraph 2 to Section 2, Part II and a new Subsection (e) to Section 1 and a new Section 3 of Part III herein; and WHEREAS, the Civil Service Board, at its regular meeting of September 17, 1974, voted to adopt the changes in Rule VI, Part II, Section 2, Paragraph 2, and Part III, Section Subsection (e) and Section3 as set forth in Sections 2 and 3 herein; and WHEREAS, it is the desire of this body to incorporate these provisions in the Civil Service Rules and Regulations of the City of Miami; NOW, THEREFORE, : BE IT ORDAINED BY. Sefviee Rules and Regulations of the dity of Miami, is hereby amended by repealing Paragraph 2, Seetion 2, Part II of Rule VI and sUbstitut ing a heW Paragraph 2 as follows: Exceptions: Employees will hot be eligible to participate itl promotional ekaminationswho have a. Been demoted for disciplinary reasons within the last twelve (12) months, or b. Failed the same or like examination within the last sit (6) months, or c. Had an Unsatisfactory Efficiency Evaluation on the preceding rating period. These exceptions may be waived by the Board upon proper showing. Section 2. That Ordinance No. 6945, passed and adopted by the City Commission of the City of Miami, Florida on November 15, 1961, being an Ordinance approving the Civil Service Rules and Regulations of the City of Miami, is hereby amended by repealing Subsection (e) of Section 1, Part III of Rule VI and substituting a new Subsection (e) as follows: e. No one except the applicant, a duly authorized agent, or the department official making a selection to fill a vacant position, as outlined in theserules, shall be allowed to examine any examination results without the consent of the Chief Examiner and the approval of the Board. Section 3.
