Regular Contributions by City
(c) The regular annual contribution by
the city shall be determined an-
nually by actuarial valuations and
on the basis of regular interest,
mortality and such other tables and
assumptions as are adopted by the
board.
(d) The regular annual contribution
shall consist of the total of the
following:
1. The normal contribution pro-
duced by the entry age normal cost
method; and
2. The accrued liability contribu-
tion produced by the entry age
normal cost method, which further
shall be determined as the annual
payment required to amortize the ac-
crued liability over a twenty-year
period, such period to commence
October 1, 1965.

The answer to the abova question is in the negative.
The pertinent provisions of Chapter 41 of the ordinances of the
City of Miami are set forth as follows:
"Immediately after the establishment of the retirement
system tha actuary shall make such investigation of the
mortality, service and compensation e.xpericnce of the
members as he shall recommend and the board shall author-
ize, and on the basis of such investigation he shall
recommend for adoption by the board such tables and such
rates as are required in subsection (15) of this section.
The board shall adopt tables andpertify rates, and as
soon as practicable thereafter, the actuary shall make
a valuation based or' such tables and rates, of the assets
and liabilities of the funds created by this division of
this chapter." Section 41-405 (14) and Section 41-430 (14).

It is clear from the above that the Retirement Board was given
the apparent authority to modify employee contribution rates up
to a maximum of one -tenth of one percent of annual earnable com-
pensation. However, the extent of the authority given is neces-
sarily confined to that of making recommendations, since the
City Commis4ion could not delegate discretionary making powers
to the Retirement Board.
As stated in cQuillen, Municipal Corporations, Section 10.40,
the City Commission may not delegate legislative or judicial
functions as distinguished from ministerial functions:
"The rule is well settled that legislative power cannot
be delegated by a municipality, unless expressly author-
ized by the statute conferring the power. So judicial,
as distinguished from ministerial, functions cannot ba
delegated. So far as the powers of a municipal corpora -

judges and the city clerk. The city manager shall fix
the number and salaries or compensation of all other
officers and employees."
