WHEREAS, a crisis exists in the Greater Miami area 'due
to the action of the 8aharnian Government in prohibiting
lobster fishing by residents of any other' government in its
graters and
WHEREAS, a meeting is scheduled to be held in Atlanta
on October 6, 1975, for the purpose of attempting to expedite
an allocation of federal funds for emergency assistance to
fishermen from the United States who are presently being de-
prived of the opportunity to earn a livelihood in their ac-
customed manner;
NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
That it does hereby urgently request the united States
Government to provide, on an emergency basis, funds for the
relief of unemployed lobster fishermen in the South Florida
area, and urges the United States Department of Commerce to
send a representative to the October 6th meeting in Atlanta
or this subject.
That Metropolitan Dade County be, and it is, hereby urged
to adopt this motion as its policy in this matter.

Dear Mr. Lehman:
This is in response to your letter of October 23, and in
further response to your November 13 letter, concerning the
possibility of EDA providing financial assistance to aid the
unemployed lobster fishermen of South Florida. As you
indicate in your letters, these then have been deprived Of
their traditional means of earning a livelihood as a result
of the recent ban on foreigners trapping the spiny lobster
in Bahamian waters.
EDA Regional Office staff in Atlanta and our Economic Develop-
ment Representative for the State of Florida, John R. Jones,
have spent a great deal of time and effort in an attempt to
find a viable solution to this problem. They met on numerous
occasions with officials from the City of Miami, Dade County
and the State of Florida, as well as with industry groups
and other Federal agencies, to discuss the problem and
determine what assistance EDA might provide within our
legislative authority and limited financial resources.
The City of Miami did develop a proposal, but indicated that
it could not meet the matching share requirement. More
importantly, some of the affected lobster fishermen are based
outside the City of Miami posing possible jurisdictional
problems. For these reasons, and the fact that a revolving
loan fund which, in most instances, is best handled at the
State level, we explored the possibility of the State being
the applicant.
You will be pleased to know that we recently authorized the
State of Florida to submit an application for Title IX grant
assistance. As soon as the application is completed, it will
be submitted to our Regional Office in Atlanta for processing.

I have written the head of the Economic Develop-
ment Administration asking him to give your application
every consideration. For your information I am enclos-
ing a copy of my letter.
As you may know, members of the Florida delega-
tion recently met with the Merchant Marine and Fisheries
Committee and representatives from the Department of
State and the Department of commerce. I assure you that
every effort is being made to find solutions to the prob-
lems now existingbetween the United States and the
Bahamas concerning territorial waters. I am also en-
closing a copy of the press release describing the meet-
ing held on September 25.
Thank you for keeping me up-to-date on your acti-
vities concerning this matter. If I can be of any fur-
ther assistance, please do not hesitate to let me know.

Dear Mr. Mizell:
understand that the City of Miami is applying
for assistance from the Economic Development Administra-
tion in order to help unemployed lobster fishermen.
As you may be aware, due to actions taken by the
Bahamian government, American lobster fishermen are no
longer allowed to fish in Bahamian waters. Although
negotiations between the United States and Bahamas have
begun, lobster fishermen nonetheless are subject to tre-
mendous losses in the meantime.
I ask you to give this matter your utmost consi-
deration. The economic relief of these fishermen is
urgently needed. Through circumstances beyond their con-
trol, they are now deprived of their traditional means
of earning a livelihood.
I appreciate your time and attention in this mat-
ter and I look forward to hearing from you soon.

man of the mouse Merchant Marine and Fisheries Committee, today
announced that Members of her Committee rnet on September 25, 1975,
to discuss the problems arising from the refusal of the Bahamian
Government to allow American -based fishermen access to the
Bahamian spiny lobster.
Also present at the meeting, in addition to Chairman Sullivan,
were representative Robert L. Leggett (D-California),Chairman of
the Subcommittee on Fisheries and Wildlife Conservation and the
Environment; Representative Edwin B. Forsythe (R-New Jersey),
Ranking Minority Member of the Subcommittee; Representatives Claude
Pepper, Don Fuqua, Skip Bafalis, Dante B. Fascell and William
Lehman of Florida; representatives of Congressmen Paul Rogers,
Robert Sikes, Bill Chappell, James Haley, Louis Frey and Sam
Gibbons of Florida; concerned fishermen; and representatives of the
State Department, the Economic Development Administrationand National

Marine Fisheries Service, of the bepartment tof
Commerce.
The problems stem from a July p declaration by the
Bahamas declaring exclusive jurisdiction over the spiny
lobster as a "creature of the shelf" 'finder the 1058
Convention on the Continental Shelf, to which the th S. is
signatory, the coastal state exercises over the continental
shelf sovereign rights for the purpose of exploring it
and exploiting its natural resources. Such rights are
exclusive in the sense that if the coastal State does not
explore the continental shelf or exploit its natural
resources) no one may undertake these activities, or make
a claim to the continental shelf, without the express
consent of the coastal State.
Fishermen attending the meeting pointed out that as
a result of the Bahamian declaration, some 350 American
based fishing boats have been unable to take spiny lobster
this season, now two months old, and further economic
losses will occur unless the problem is resolved. The
normal spiny lobster season lasts from four to six
months, they said, but the first two months is the most
productive, and about 50 percent of the normal season's
catch has already been lost.

27, of this year, were suspended without resolution of
the impasses
Chairman Sullivan noted that the September 25
meeting was called to provide her Committee with all of
the facts on this problem and said: "We will be working
with the appropriate Federal arencies and other
interested persons in an effort to find some way of
resolving these problems."
