HomeMy WebLinkAboutO-08443O ibINANet i s 8443 AN EMER+ENCY ORDINANCE SETTING FoRT1 A PRO* POSED CHARTER AMENDMENT AMENOINd SECTION 60 OF' THE CHARTER OP THE CITY OF MIAMI TO PROVIDE THAT THERE SHALL BE SEVEN (7) MEMBERS oP THE CIVIL SERVICE BOARD, FIVE (5) OP WHICH SHALL BE APPOINTED BY; THE CITY COMMISSION; SUBMITTING THE PROPOSED CHARTER AMENDMENT TO THE ELECTORS OP THE CITY OP MIAMI A. THE GENERAL MUNICIPAL ELECTION oN NOVEMBER 4, 1975: PROVIDING THAT THIS CHARTER AMENDMENT SHALL BE REFERRED TO AS PROPOSED CHARTER AMEND- MENT No, 2: REPEALING ALL ORDINANCES, CODE SECTIONS OR PARTS THEREOF IN CONPLI,CT, AND CONTAINING A SEVEMBILITY PROVISION. WHEREAS,Section 60 now provides that there the said civil service board, by the commission and two (2) of which shall be elected by the em- ployees of the City of Miami with civil service status, from said employees with such civil service status; and WHEREAS, the city commission of ,the City of Miami deems interests of all of the people of the City the citizen representation on said civil addition of two (2) members so that the it to be in the best of Miami to increase service board by the of the Charter of the City of Miami. shall be five (5) members constituting three (3) of which shall be appointed 'board shall be comprised of seven (7) members, • are to be.appointed by the city commission; NOW, THEREFORE,BE IT ORDAINED BY THE: COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The city commission of the City of Miami hereby submits the following proposed charter amendment for - general five (5) of which submission to the electors of the City of Miami at the municipal election on November 4, 1975, Said amendment shall become effective December 1, 1975 ,CHAttnk, AMENDMENT_N(b_,_2 Section 60 of the City of Miami Chatter, Chapter 10847, Special Acts, LaWS of Florida, 1925, as amended or supplemented, is, hereby amended by amending Section 60 to read as follows: 1/. Sec. 60. Civil service .L Creation of board; appointment; termsof office; vacancies; rules and regulations. That a civil service board of the City of Miami, a municipal corporation of the State of Florida, be, and the same is hereby created and established: and that there shall be five seven members constituting the said civil service board. £FkiEee Five (5) shall be appointed by the commission and two (2) shall be elected by the employees of the City of Miami with civil service status, from said employees with such civil service status. The two so elected shall become members of the board when confirmed by the city commission. All members of the said civil. service board shall serve for two years, and they shall take office as soon as appointed and qualified. The commission may remove any member of the board for cause, upon stating in writing the reasons for the removal, allowing him or her to be heard by the city commission in their own defense. Any vacancy shall be filled by the commission for the unexpired term. The city manager shall be, and he is hereby, authorized to prescribe the rules, regulations and procedure for the holding of election for the purpose of electing the two (2) members of the civil service board by the city employees with civil service status. Section 2. The proper city officials are instructed and directed to take the actions necessary for the submission of this proposed charter amendment to the electors of the City of Miami by placing it on the ballot as CHARTER AMENDMENT NO. 2 in substantially the following form: Shall Section 60 of the Charter of the City of Miami be amended to provide for a seven (7) member. board instead of: a five (5) Member board and to provide that five (5) of the seven (7) members shall be appointed by the city commission? eras.-s r. rre ee.. r-W-ti ne e. r, --_r e•er.rR er ear er re! 1/ Words stricken through shall be deleted, Underscored words constitute the amendment proposed, Remaining provisions are now in effect and remain unchanged, Section .8. Ali Cotdihantes, Code sections dr parts therein in Conflict herewith, insofar as they are in conflict, are hereby repealed: Section 4. If any section, sentence, clause, phrase, or word of this ordinanceis for any reason held or declared to be unconstitutional, inoperative, or void, suchholding or invalidity shall not affect the remaining portions of this ordinance; and it shall be construed to have been the intent of the commission of the City of Miami to pass this ordinance without such unconstitutional, invalid, or inoperative part therein; and the remainder of this ordinance, after the egclusion of such part or parts, shall be deemed and held to be valid as if such partshadnot been included therein. Section 5. Thisordinance is hereby declared to be an emergency measure on the ground of urgent public need for the preservation of peace, health, safety and property in the City of Miami. Section 6. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the city commission.. AN ORt/NANCE PROVIDING THAT Tt#E TG+t0 ELECTED MEM$ERS or THE CIVIL SERVICE BOARD SHALL BE ELECTED IN THE ?OLLbw= IMO MANNER: ONE tiNIFORMED EMPLOYEE WITH CIVIL SERVICE STATUS SHALL BE ELECTED BY UNIFORMED POLICE AND FIRE EMPLOYEES; AND ONE GENERAL EMPLOYEE WITH CIVIL SERVICE STATUS SHALL BE ELECTED BY THE GENERAL EMPLOYEES. WHEREAS, Section 60 of the Charter of the City of Miami provides that two (2) employees with Civil Service status shall be elected to the Civil Service Board; and WHEREAS, it is the intent of the Commission of the City of Miami that one of the members be elected from the Police and Fire Departments by uniformed police and fire employees and one of the members shall be elected by the general employees; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The two elected members of the Civil Service Board shall be elected in the following manner: One uniformed employee with civil service stat 11 be elected by uniformed police and fire employees; and one general employee with civil service status shall be elected by the general employees. Service status. Item No. 38 oh the Slily 31, 1975, City Commission Agenda is a pro- posed Charter change that would formally specify that the employee representation on the Civil Service Board would be as outlined above. Upon communicating with the City Attorney's Office, the City Manager is advised that inasmuch as the Charter specifies that the Civil Service Board members should include two employees with Civil Service status, it is within the purview of the City Commission to accomplish by reso- lution what is outlined in the proposed Charter change.
