AN ORDINANCE AMENDING ORDINANCE NO. 6871,
THE COMPREHENSIVE ZONING ORDINANCE FOR THE
CITY of MIAMI, ARTICLE IV, SECTION 26, AS IT
RELATES TO RESTAURANT SEATING, EY..DELETINO'
SUBSECTION 3 IN ITS ENTIRETY AND S tBSTITttTINC
IN LIEU T tEREOP NEW SUB- ECTIONS (3) AND (4) ;
REPEALING ALL ORDINANCES, CCObE SECTIONS OR PARTS
THEREOF IN CONFLICT INSOFAR AS TREY ARE IN
CONFLICT; AND CONTAINING A SEVERABILITY PROVISION.
WHEREAS, the Miami Planning Advisory Board at its
meeting of dune 18, 1975, Item No. 2, following an advertised
hearing, adopted Resolution No. PAB 52-75 by a 5 to 1 vote
(one member absent) recommending an amendment to Ordinance
No.comprehensive
6871, the Com rehensive Zoning Ordinance of the City of Miami,
bydeleting sub -section 3 in its entirety and substituting in
lieu thereof new sub -sections (3) and (4) to Section 20
Article IV as hereinafter set forth; and
WHEREAS, the Commission deems it advisable and in
the best interest of the City of Miami and its inhabitants to
amend said ordinance as hereinafter set forth;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION

Zoning Ordinance for the City of Miami, Article IV, Section 20,
as it relates to restaurant seating, be and the same is hereby
amended by deleting Sub -section 3 in its entirety and
substituting in lieu thereof new Sub -Sections (3) and (4)
to read as follows:
(3) The operation of all convenience -
commercial establishments shall be
subject to the following limitation:
(a) All access to any such use,
except for necessary service
entrances nd fire exits shall
be from bOW lobby, or other
interior portion of the building,

(4) The operation of.restaurants shall be
subject to the folioWing limitations:
(a) size:One (1) seat for each
one and one-half (1I) dwelling
units up to. a fiaXimUM of three
hundred seats including the Waiting
lounge areas. The gross area of the
facility shall be limited to 'twenty
(20) square feet for each dwelling
unit. The lounge area shall not
exceed twenty (20) percent of the
total number of seats permitted.
In office developments restaurants
shall be limited toone (1) square
foot for each 20 square feet of
gross floor area.,
(b) Parking: Off -Street Parking
shall be immediately adjacent and
reserved for the restaurant.
(c) Entry and Exiting: Curbs cut for
access to the restaurant area .shall
not be closer than one hundred (100)
feet from the intersection: of any
streets. Access to the restaurant
and restaurant parking area shall be
from an arterial street or by way of
a service road connecting to ,an
arterial street. Access to the
parking, area shall be designed
so as to provide!. sufficient stacking
area for incoming patrons.
(d) Loading: Restaurant facilities shall
provide an adequate loading area which
shall be screened and buffered from
visibility from the surrounding
residential development, and the
entry ways of boththe principal, use
and restaurant facility.
(e) Landscaping and Amenities: The
location, orientation, design and
landscaping shall be, :provided so
as to separate the restaurant
activities and the activities of
the principal use and the other
ancillary uses of the principal use.
Section 2. A11 ordinances, code sections, or
parts thereof in conflict herewith, insofar as they are in
conflict, are hereby repealed.

Item #2, following an advertised Hearing, adopted Resolution No.
PAD 52-75 by a 5 to 1 vote (one member absent) recommending an
Amendment to Ordinance 6871, The Miami Comprehensive Zoning Ordi-
nance, ARTICLE IV, Section 20, by deleting sub --section 3 in its.
entirety and substituting in lieu thereof a new sub -paragraph 3
and 4 as shown on pages 26 and 27 of the attached minutes.
