AM ORDINANCE AUTHORI2ING THE OPMI, E
PARKING BOARD OF THE CITY OF MIAMI, oR
THEIR SUCCESSORS, TO ADMINISTER THE
FACILITY KNOWN AS GUSMAN HALL LOCATED
WITHIN THE CITY OF MIAMI; PROVIDING
GUIDELINES TO BE UTILIZED IN THE
ADMINISTRATION OF SAID FACILITY;
PROVIDING FOR THE APPOINTMENT OF AN
ADVISORY COMMITTEE CONSISTING OF FIVE
MEMBERS, WITH MAURICE GUSMAN AS HONORARY
CHAIRMAN, TO. ADVISE SAID OFF-STREET
PARKING BOARD ON MATTERS OF POLICY.
CONCERNING. THE OPERATION OF SAID FACILITY;
CONTAINING A SEVERABILITY PROVISION;.
DECLARING THIS ORDINANCE TO BE AN
EMERGENCY MEASURE;AND DISPENSING WITH
THE REQUIREMENT OF READING THE SAME ON
TWO SEPARATE, DAYS BY A VOTE OF NOT LESS
THAN FOUR -FIFTHS OF THE MEMBERS OF THE
COMMISSION.
WHEREAS, Maurice Gusman, one of the great benefactors
in the South Florida area, has generously executed a deed giving
Gusman Hall, a great memorial to hisgenerosity, to the City of
Miami; and
WHEREAS, Maurice Gusman, being aware of the recognition
the Department of Off -Street Parking has acquired nationally
because of its highly successful operation, and because, of his
esteem and respect for the individual members of the Off -Street
Parking Board; Mitchell Wolfson, Chairman; Arnold Rubin, Vice
Chairman; A.T. Beckwith, Marx D. Cauthen and Russell A. Jones,
has stipulated that the members of this Board or their successors,.
manage the affairs of Gusman Hail; and
WHEREAS, said Board has indicated
to do so; and

culture, and the control of off-street parking facilities are
such that the Off -Street Parking Board of the City of Miami -
should exercise the powers which are conferred upon it to manage
the affairs of Gusman Mall; and
'WHEREAS, such'management by said Board is in the. best.
interestof the:City of Miami; and
WHEREAS, because of the nature of the operation'of
Gusman Hall
it is essential that direction
regarding such opera-
tion begin immediately and,therefore, authority for such operation
must begin to be exercised immediately;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA;.
Section 1. The members of the Off -Street Parking Board
of the City of Miami, or their successors, are hereby authorized
to administer the facility known as Gusman Hall and located at
174 East Flagler Street, Miami, Florida,; on the property legally
described as follows:
Lot . 1, Lot 2 (less the West ' 2 inches of
the North 65 feet), the 'South 55 feet of
Lot 3, and the North 45 feet of Lots
18, 19 and 20, Block 121 North,' CITY OF
MIAMI, according to the Plat thereof, as
recorded in Plat Book 13, at Page 41, 'of
the Public Records of Dade County, Florida.

personnel or independent contractors as are necessaryfor such.
Negotiate and enter into agreements or leases

for the use of the auditorium and other available space in the
building on the: property.
(c) ,Provide for appropriate means of accounting and

bookkeeping sothat the financial affairs of the facility are.
adequately administered and accounted for.
(d) ,Provide leaderdiip and guidance so that.the
facility may be financially sound in'its operation as well as
being a cultural and artistic success, and a noteworthy monument
reflecting credit upon The City of Miami, and an outstanding
attraction.in the downtown area.
(e) Establish a. maintenance fund for the upkeep of
.the building and establish such reserve funds from the income
of the facility as are deemed by the members, of the Off-
Street
parking Board to be necessary for the successful operation of
the facility.
(f) Make periodic reports to the City Commission
which shall reflect the financial condition of the operation
of the facility.
Section 2. :The.Off-Street Parking Board is authorized
to, appoint an advisory- committee. with Maurice Gusman as honorary
chairman, consisting of five dedicated, civic individuals
representative of the community. Such committee Shall. advise
the said Off -Street Parking Board on matters of'poLicy concerning
the operation of the auditorium

Section 4. I any Sedtion► Sentende, Olaitee phrase
or Word of this ordinance is for ' anti reason held. or, dedlared
to be unconstitutional, inoperative. or void, such hold ing or. in',
validity shall not affect the remaining portions of this Ordin-
ance, and it shall be construed to have been'the intent of the
Commission of the City of Miami to pass this Ordinance without.
Such unconstitutional, invalid, or inoperative part. therein;
and the remainder of -this Ordinance,'after_the exclusion of such
part or, parts,, shall be deemed and held to be valid as if such
parts had not been included therein.
Section 5. This Ordinance, is hereby declared to be
,emergency measure on the ground of urgent public need for the pre-
servation of peace, health isafety and property in the City of
Miami.
Section 6. The requirement of reading this Ordinance
on two separate days is herebydispensed with by a vote of not
less than four -fifths of the members of the Commission.
