WHEREAS, the City of Miami ("City") has been awarded a grant by the United States Department of
Justice, Office of Justice Programs, Bureau of Justice Assistance ("BJA") in the amount of $500,000.00, with no
required local match ("Grant"), to provide the Miami Police Department ("MPD") funding to review and update
unsolved cold case investigations; and
WHEREAS, the grant award will allow the MPD to implement a streamlined process to ensure each cold
case is reviewed, handled with meticulous attention to detail, and collaborate with the Miami -Dade Police
Department's ("MDPD") Forensic Services Division to leverage the latest forensic technologies to enhance the
likelihood of solving cold cases; and
WHEREAS, the Grant funds will be utilized to support MPD expenditures for personnel overtime, travel,
supplies and collaborative efforts with MDPD's Forensic Services Division; and
WHEREAS, the Grant period commences on October 1, 2024, through September 30, 2027;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:

Section 1. The recitals findings contained in the Preamble tc,414. s Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The following new Special Revenue Project is established and resources are appropriated
as described below:

Section 3. The City Manager is authorized[1] to execute a Grant agreement, in substantially the
attached form, to accept the Grant funds from BJA, and to appropriate said funds to MPD to support
expenditures of MPD's Cold Case Detail to complete a certified inventory of unresolved cold case investigation.
Section 4. The City Manager is further authorized' to designate the Chief of Police, or other designee, to
negotiate and execute any and all other necessary documents, all in forms acceptable to the City Attorney, to
implement the acceptance and administration of the Grant.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.[2]
[1] The herein authorization is further subject to compliance with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by applicable City Charter and City Code provisions.
[2] If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date
it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the
veto by the City of Miami Commission.

Dear Arthur Noriega V,
On behalf of Attorney General Merrick B. Garland, it is my pleasure to inform you the Office of
Justice Programs (OJP) has approved the application submitted by CITY OF MIAMI for an award
under the funding opportunity entitled 2024 BJA FY24 Prosecuting Cold Cases Using DNA. The
approved award amount is $500,000.
Review the Award Instrument below carefully and familiarize yourself with all conditions and
requirements before accepting your award. The Award Instrument includes the Award Offer
(Award Information, Project Information, Financial Information, and Award Conditions) and
Award Acceptance. For COPS Office and OVW funding the Award Offer also includes any Other
Award Documents.
Please note that award requirements include not only the conditions and limitations set forth in
the Award Offer, but also compliance with assurances and certifications that relate to conduct
during the period of performance for the award. These requirements encompass financial,
administrative, and programmatic matters, as well as other important matters (e.g., specific
restrictions on use of funds). Therefore, all key staff should receive the award conditions, the
assurances and certifications, and the application as approved by OJP, so that they understand
the award requirements. Information on all pertinent award requirements also m ust be
provided to any subrecipient of the award.
Should you accept the award and then fail to comply with an award requirement, DOJ will
pursue appropriate remedies for non-compliance, which may include termination of the award
and/or a requirement to repay award funds.
Prior to accepting the award, your Entity Administrator must assign a Financial Manager, Grant
Award Administrator, and Authorized Representative(s) in the Justice Grants System
(JustGrants). The Entity Administrator will need to ensure the assigned Authorized
Representative(s) is current and has the legal authority to accept awards and bind the entity to
the award terms and conditions. To accept the award, the Authorized Representative(s) must
accept all parts of the Award Offer in the Justice Grants System (JustGrants), including by
executing the required declaration and certification, within 45 days from the award date.
To access your funds, you will need to enroll in the Automated Standard Application for
Payments (ASAP) system, if you haven't already completed the enrollment process in ASAP. The
Entity Administrator should have already received an email from ASAP to initiate this process.

The Office for Civil Rights (OCR), Office of Justice Programs (OJP), U.S. Department of Justice
(DOJ) enforces federal civil rights laws and other provisions that prohibit discrimination by recipients
of federal financial assistance from OJP, the Office of Community Oriented Policing Services

Several civil rights laws, including Title VI of the Civil Rights Act of 1964 and Section 504 of the

provisions by investigating DOJ recipients that are the subject of discrimination complaints. In
addition, OCR conducts compliance reviews of DOJ recipients based on regulatory criteria. These
investigations and compliance reviews permit OCR to evaluate whether DOJ recipients are providing
services to the public and engaging in employment practices in a nondiscriminatory manner.

The scope or location or the proposed project is such that it may not qualify for a categorical
exclusion as contained in Appendix D to Part 61 of Title 28 of the Code of Federal Regulations.
As such, prior to initiation of the project, the grantee may need to complete an Environmental
Assessment (EA) and/or an Environmental Impact Statement (EIS).
Additional information is needed to determine if any of the following activities will be
conducted as a result of this award, whether under the Office of Justice Programs federal action
or a related third party action:

(2) Any renovation or remodeling of a property located in an environmentally or historically

Memorandum of Understanding
BETWEEN
The FL Institute of Forensic Anthropology & Applied Science at
the University of South Florida
AND
The City of Miami Police Department
PURPOSE:
The purpose of this Memorandum of Understanding (MOU) is to establish a good -
faith foundation between the Florida Institute of Forensic Anthropology and
Applied Science at the University of South Florida (herein referred to as "IFAAS")
and the City of Miami Police Department (herein referred to as "Miami PD") for
future collaborative criminal justice efforts. IFAAS is a nation-wide service
provider established to aid the medico -legal community in the area of cold case
homicide investigations, missing and unidentified persons, and other historic justice
initiatives.
An additional purpose of this MOU is to clearly identify the roles and
responsibilities of IFAAS pertaining to exhumation of human remains for DNA
analysis. Both Parties agree to work together in a cooperative and coordinated
manner to achieve each Party's individual goals and the collective goals of the
partnership.
II. IFAAS RESPONSIBILITIES UNDER THIS MOU:
As a contractor of Miami PD, IFAAS shall undertake the following activities:
1. Assist with collecting and processing DNA evidence, including
photography, notes, sketches, etc. DNA samples will be collected and turned
over to Miami PD, who will retain legal custody of the samples and ship
them for DNA testing.
Other technical assistance and anthropology services provided by IFAAS include
skeletal and trauma analysis, clandestine grave searches, forensic facial and
clothing approximations, records review and analysis, odontology services, and
assessment of time since death. These services may or may not be required by
Miami PD.
IFAAS follows standard practices and protocols for human identification in forensic
anthropology and uses a data collection protocol that was produced through an NIJ-
funded research initiative. The Forensic Anthropology Laboratory Manual (also
referred to as the Lab Manual) provides guidance and sets standards to ensure that
research, historic projects, and forensic casework and identifications are
scientifically sound and legally defensible. It helps establish uniformity and
standardization of data collection and analysis. The manual includes sub -sections
for data collection in the lab, field methods, and cold case reviews. All personnel,
including faculty, students, interns, etc., sign an agreement accepting the terms of
the lab policies and procedures. Laboratory Policies include, but are not limited to:
• A Code of Ethics, wherein members of IFAAS will not misrepresent themselves
or their work;
• A Confidentiality Code, wherein IFAAS personnel refrain from taking, sharing,
publishing, or displaying any photograph, data, or report without prior
authorization;
• Maintaining Scientific Integrity, meaning that personnel adhere to the scientific
method with transparency and accountability for all actions. This includes
operating in an objective fashion free from managerial or political influence or
bias.
III. MIAMI PD RESPONSIBILITIES UNDER THIS MOU INCLUDE:
Miami PD shall undertake the following activities:
1. Provide resources and support for IFAAS, utilizing the expertise and support
of Miami PD personnel and networks when needed;
2. Provide fiscal sponsorship, not to exceed six thousand US dollars ($6,000)
of the collecting and processing of DNA evidence with IFAAS as a
contractor.
3. Assist with documentation and DNA evidence collection; and
4. Submit any/all DNA samples obtained by IFAAS for DNA testing and
analysis.
IV. MOU TERM:
The term of this MOU is the period within which the project responsibilities of this
agreement shall be performed. This MOU will be valid for one (1) year unless
terminated by one of the Parties. Either Party may withdraw from this MOU
provided written notification of the withdrawal is given to the other institution at
least two (2) months prior to the desired withdrawal date. This MOU may be
renewed for another period of one (1) year upon mutual written consent of the two
Parties before the expiration date.
V. EFFECTIVE DATE AND SIGNATURES:
This MOU shall be effective upon the signature of IFAAS and Miami PD authorized
officials. Both Parties indicate agreement with this MOU by their signatures.
