WHEREAS, substance abuse has beeh .defined as
the excessive or illegal use of drugs, narcotics, and other
hallucinatory ,substances (not including alcohol) which have
created personal dependency on, such substances; and
WHEREAS, the City commission deems it advisable
and in the best interest of ,the inhabitants of the City of
Miami to establish an Advisory Committee on substance abuse
as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED, BY THE COMMISSION
OF TEIE CITY OF MIAMI, FLORIDA:
Section 1. There shall be established within the,.
City of Miami an Advisory Committee on Substance Abuse, as
follows:
(a) COMPOSITION ,
The committee shall consist of five (5) members,.
having expertise in the field of substance abuse
who shall be appointed by the City Commission.
(b) TERM OF OFFICE
A11 members shall be appointed for two (2)
year period and shall serve without compensation.
The first term of office shall commence when the
final appointment to the Board is made.
(c) PURPOSE AND RESPONSIBILITY
The Committee shall review the operations and
objectives of each proposed substance abuse
Program in terms of location, land use, building,
and other standards adopted for substance abuse

Meetings shall be di -lied as neoessar'y by the
Committee Chaitpersoh upon reeeipt of applications
for donsideratieh ftottt either the tuilding beptrt-
Ment (Jr the bepartmment of Ad ,ihistration Planning
and zoning Boards. All meetings shall be open to
the public and minutes shall be taken.
(e) R8PORT AND ..0 COMM8NDATTONS
The minutes of each meeting together With the report.
and recommendations of the Committee shall be
forwarded to the appropriate City of Miami department
to become a part of the permanent file relating to
the subject property.
(f) CI-HAIRPERSON
At its first meeting, the Advisory. Committee shall
select from among themselves a chairperson, whose
responsibility shall, be to officiate over and con-
duct orderly meetings. At the, first meeting ;follow-
ing theanniversary date of the nomination of the
chairperson, a chairperson for the second year shall
be selected from among the Committee members.
(g) SECRETARY
The Committee shall select from among themselves a
secretary whose responsibility shall•be to take
minutes at each meeting. Thesecretary, shallbe
selected at the same meeting the Chairperson is
selected.
Section 2. All laws or parts of laws in conflict here-
with be, and the same are hereby repealed insofar as they are in
conflict.
Section 3. If any section, sentence, clause, phrase, or
word of this Ordinance is for any reason held or declared to be un-
constitutional, inoperative or void, such holding or. invalidity
shall not affect the remaining portions of this Ordinance, and it
shall be construed to have been the intent of the Commission of the
City of Miami to pass this Ordinance without such unconstitutional,
invalid or inoperative part therein; and the remainder of this.

shall be deemed to be valid as if such parts had not been

Section 4, that the teclUlreitent of reading this
ordinance oh two separate clays is hereby dispensed With by a
vote of not less than four/fifths of the Members of the
Commission.

become. effective immediately upon passage.

At the City Commission meeting of May 22, 1975, Ordinance No. 8390 was
passed which established a five member Advisory Committee on Substance
Abuse to snake recommendations to the City pertaining to all future substance
abuse facilities; two of the five Committee members were to be City employ-
ees. Since the main qualification for Committee membership is expertise in
substance abuse facilities and programs, it is recommended that the ordinance
be amended so that all five Committee members will sheet the main qualification,
and that whatever technical expertise is required by the Committee will be
provided by the City administration.
For your review, the amended ordinance is attached to this memorandum. If
the City Commission follows the recommendation and adopts the amended ordin-
ance on an emergency basis, it is also requested that the Commission appoint
five members to the Substance Abuse Advisory Committee.
