At the May 8, 1975, City CoMtn ssiori meeting, there was discussion of a
request to amend Ordinance 8038 to include the Assistant to the Executive
Secretary of the Civil Service Board, the Assistant City Clerk and the
Assistant to the Director of the Department of Administration Nanning and
Zoning Board, to be recipients of certain executive pension benefits,
Ordinance 8038 provides:
' : , ..upon service retirement if a member of said Retirement
System or Retirement Plan has three or more years service
since last becoming a member,- he shall also receive a pension
equal to one percent (1%'0) of average final compensation for each
year of service or fraction thereof that such member served as
the City Manager, Assistant City Manager, City Clerk, Executive
Secretary of the Civil Service Board, Executive Secretary of the
Planning and Zoning Board, City Physician, City Attorney,
Assistant Director of the Department of Law, or as Director or
Assistant Director of a Department established by the Charter of
the City of Miami or by ordinance as authorized by said Charter,
provided he has served in any of such capacities for a total com-
bined period of not less than three years; subject therein to a
maximum length of service amounting to ten years for the purpose
of computing such additional pension allowance thereunder....
Ordinance 8038 was adopted with the benefit of a review by the City's Actuary
who specifically evaluated the affect of the ordinance and the specific executive
positions included therein as to its annual cost to the City and to the City's
pension program.
I have researched the matter of amending Ordinance 8038 to include the following
three positions as requested at the Commission meeting of April 18, 1975, and
also as requested in a memorandum to me dated February 14, 1975, by the three
encumbents in these positions:

1 retornniend that no action be taken by the City riis sign regar
this request for the following reasons;
1. There are a. number of positions in the City Adrnifistratiofi
that carrot more responsibility, require higher supervisory
capability and are paid a higher salary compensation. To single
out these positions for inclusion in the executive pension benefits
provided tinder Ordinance 8038 would not be in keeping with the
intent and purpose of the ordinance nor be in equity to other City
positions.
Attached you will find a summary of some of the positions in the
executive/supervisory class that cause me to recommend that the
City Commission take no action on this request at this time.
2. To grant additional positions to participate in the executive
pension program benefits would create a serious funding problem
to the City of Miami. The full impact of this funding problem
could only be revealed after an actuarial study.

Ordinance No. ao39 adopted February 17, 1972, granted additional re-
tirement Benefits to department heads .and their assistants, the City
Manager and his assistant, the City Attorney and his assistant, the
City Clerk, but not his assistant., the kkecutive Secretary of the civil
Service Board, but not his assistant, and the txecutive Secretary of
the Planning and Zoning Board, but not his assistant.
This was, 1 feel, an oversight --and indeed t4a8 recommended by the
Retirement Soard to be corrected in March of 1972.
The City Clerk's office, though it has a small staff, boars a serious
responsibility for accurately interpreting the actions and intentions
of the City Commission and promulgating its decisions, and both my
assistant and accept this responsibility with the seriousness which
it deserves; and I ,wholeheartedly endorse the request to include the
Assistant City Clergy in the category established by said Ordinance
No. 8038 to receive additional pension benefits.

As the former Chairman of the Retirement Board of the Miami City Employees' Retirement
System and General Employees' Plan, 1 am fully aware of the action of the Board, when,
on March 8, 1972, the Board voted 6.1 (Member R.L. Parks dissenting) to recormend the
inclusion of the Assistant Executive Secretary of the Civil Service Board and the
Assistant Executive Secretary of the Planning Board in Ordinance P8O38. As you are
award, this recommendation did not reach the City Commission until introduced by
Com►nissioner Gordon on May 8, 1575
In addition, I am aware of the action on the part of my Assistant, Joe Yates, and
Robert Davis, in the Department of Administration, Planning and Zoning Board, along
with the addition of the Assistant City Clerk, Ralph Ongie, to gain the added pension
benefit.
Although their request covers the position of Robert Davis, as the former Assistant
Executive Secretary to the Planning Board, Mr. Davis is now covered under Ordinance
P O33 since he is now an Assistant Director of a department.
The only Assistants remaining would be Mr. Yates of the Civil Service Office and
11r. Ongie of the City Clerk's Office.
Speaking of Mr. Yates, he is and has been serving in the full capacity of Executive
Secretary during every absencethat has been necessary by myself and has the same
ant:hority is the Executive Secretary in my absence. For the past two years, ,I have
h-ni to spend considerable tide out of the Civil Service Office, attending meetings
:rith the City Manager, The University of Chicago, Tri-Cultural Committees, etc., thus
placing Mr. Yates in control of all functions of the Civil Service Office.
I have had to rely on Hr. Yates' 25 years of knowledge and without his cooperation and
assistance, I would have faced many difficulties in serving as Executive Secretary for
the Civil Service Board.
I therefore wholeheartedly endorse the request to include ray assistant in Ordinance
#8038 and feel that this action should have been considered in 1972 as shown on the
attached page of the Retirement Board Minutes.
