It has come to the Cityts attention that the plans for a structure
to be built at 3326 Mary Street indicate a northward encroachment
of two footings into an adjacent alley by more than three feet.
A building permit was issued for the proposed work last dune, but
construction was delayed because of economic conditions, and the
matter has just recently come to light.
From a review of the plans in our office, it appears that in each
case the footing could be redesigned and combined with one to the
south, and the encroachment could be limited to less than the six
inches allowed by the South Florida Building Code. While we lack
complete detailed plans, it appears that in the case of the westerly
footing this could be done at a cost not exceeding several hundred
dollars. Although the easterly footing is a little more complicated,'
already carrying loads from five columns, it appears that the en—
croachment here could be also limited to the allowable six inches' by
combining it with the next column to the south. It would surprise
us if this would cost as much as $800 to accomplish.
We see no need for the City to accept the excessive encroachment as
proposed by the architect and recommend that the foundation be
redesigned to eliminate it.

This is a rescheduling of Item 13 which appeared on the agenda for
the Commission meeting of May 22nd, 1575.

Mary Street Alley
Of April 15th, 1975 wrote to Mr. Bob ?erencik, the
Director of the ' Building Department, .notifying hire
bf the construction of a building whose footings
were encroaching into a private alley four to five
feet.
This alley runs east and west between Mary Street
and Day View Street just south of Oak Avenue. At
the present time both electric and telephone
facilities are existing in this alley. I see no
need for the gas or water and there are sanitary
sewers in the surrounding streets
As you know, the building code allows foundations
to extend into rights -of -way six inches, but we think
that this could possibly be a precedent allowing a
foundation to go half way across a private alley.
