AFORESAID COSTS
WHEREAS, by Resolution No. 74-494, the City Commission
accepted in principle the African Square Linear Park Project
and instructed the City Commission to take preliminary steps
necessary, leading to the acquisition of the properties; and
WHEREAS, by Resolution No. 74-342 the Commission of
the City of Miami determined that said properties shall be
acquired for the creation of the African Square portion
Martin Luther King Boulevard. Park, further authorizing the
City Attorney to commence condemnation proceedings; and
WHEREAS, the law firm of Korner and Sampson was
retained by the owner of Lots 8, 9 and 10, Block 10, Orange
Heights; and
WHEREAS, by statute, the City of Miami, the con-
demnation authority is required to pay reasonable attorney's
fees and costs arising out of this condemnation action although
this particular property was eventually determined not to be
needed for the proposed park;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA

Section 1. The City Manager be, and he is hereby,
autloriZed and directed to instruct the proper City Officials
to pay the following costs arising from a condemnation action
for the creation of the African Sgt.iare portion of the Martin
Luther King Boulevard Park:
Korner and Sampson, P.A.
George A. Friz, Jr., Appraiser
Owen Colliflower, Court Reporter
$1,875.00
250.00
105.00
Total $ 2, 230.00
Section 2. The proper City Officials be, and they
are hereby, authorized to allocate the aforesaid amount to
cover the costs arising from the condemnation action from
the Parks for People Bond Fund.
