WHEREAS, the City of Miami has been requested to grant quit claim deeds for a 50-foot strip of land whioh runs through the properties of the two owners requesting same; and WHEREAS, this strip had been originally dedicated to the City in 1923 for street purposes, and was subsequently designated by the City as S.W. 6th Terrace; however, it was never maintained by the City, and was never required in any of its future planning;.and WHEREAS, in 1940, the City of Miami, under Ordinance No. 2278, passed and adopted March 14, 1940, formally abandoned S.W. 6th Terrace, and by Plat 42/6, ownership thereof went to the abutting owners; and WHEREAS, the aforesaid deeds are now needed by these owners to make certain, and otherwise forever quiet the title to the aforesaid strip; and WHEREAS, investigation of the ground in said location reveals that the only utilities in said area are an 8-inch sanitary sewer and an 8-inch water main, which are privately owned and maintained, and are not the responsibility of the City of Miami; and WHEREAS, further investigation reveals that S.W. 6th Terrace is not included in any present or future plans of the City of Miami; and tt CITY COMMISStON MEETING OF MAY 2 21975 RESOLUTION MO..,/6.s.5$- REMARKS, ,,,,, ,,, ,,,,,,,,f,,.,,,,,, I 2 4 5 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 WaRBAS, it is i9 w in order for the City COmmiaa f t i authorite the 'City Manager to execute and deliver the aforesaid t uit Claim `heeds as requested by and to the abutting owners ; MOW, TRBRRPORB, BE IT RESOLVED B` ` THE OF THE CITY OP MIAMIr FLORIDA; Section 1. The City Manager is authorized to execute and deliver Quit Claim Deeds releasing any interest which the City of Miami have in and to that certain 50-foot wide strip of land formerly designated as S.W. 6th Terrace, located between S.W. 1st Avenue and S.W. 2nd Avenue, to and in favor of Fomack Realty Corporation, the owner of the easterly one-half more or less thereof; and to William B. Brickell and E. Langdon Laws, Trustees, the owners of the westerly one-half, more or less thereof; and to forward said Deeds to Mr. Robert G. Hewitt, Suite 2150, First Federal Building, 1 S.E. 3rd Avenue, Miami, Florida, 33131, Attorney representing both owners. PASSED AND ADOPTED this 5 day of JUNE OMMISS IO1, I xzrES H. D. Ur Although Plat 42/6 was approved by the City Commission of Miami under Ordinance No. 2278, passed and adopted March 14, 1940, whose express purpose being to close and discontinue for public use the street formerly known as S.W.6th Terrace, we have now been requested to grant quit claim deeds +te the two abutting owners of interest, in order to make certain, and otherwise, to forever quiet, the title to their respective interests in the aforesaid S.W.6th Terrace. Investigation of the underground of S.W.6th Terrace revealed that the only existing utilities, an 8-inch Sanitary Sewer and an 8-inch water main, are privately owned and maintained,' and are not the responsibility of the City of Miami. S.W.6th Terrace is not included in any present or future plans of the City of Miami. It is now in order for the City Commission to direct the City Manager to execute and "delver the aforesaid quit claim deeds as requested, by and to, the abutting owners of interest._ THE DEPARTMENT OF PUBLIC WORKS RECOMMENDS ADOPTION OF THE RESOLUTION DIRECTING THE CITY MANAGER TO EXECUTE AND DELIVER. QUIT CLAIM DEEDS CONVEYING ALL THE INTEREST WHICH THE CITY OF MIAMI HAS IN AND TO THAT CERTAIN STREET FORMERLY DESIGNATED AS S.W.6th TERRACE, TO AND IN FAVOR OF FOMACK REALTY CORPORATION, THE OWNER OF THE EASTERLY ONE-HALF, MORE OR LESS THEREOF, AND TO WILLIAM B. BRICKELL AND E.LANGDON LAWS, TRUSTEES, OWNERS OF THE WESTERLY ONE-HALF, MORE OR LESS THEREOF, c/o MR. ROBERT G.
