Betty Mayes Allen regarding the `ledge height limitations. The height of fences, walls and hedges is specified in Section 17 of Article 1V of the Comprehensive Zoning Ordinance. With relation to the specific case at hand, the notice to firs. Hayes was issued on April 17, 1975 as a result of a complaint received from a neighboring property owner. The provision of the Zoning Ordinance with relation to the height of fences is enforced on a purely selective basis other than upon receipt of a complaint. The only time action is generated by this Department with reference to a hedge is when it is noted that vision clearances are obstructed. It is my opinion that any attempt to uniformly enforce the hedge height limitations would generate public out cry. On the other hand, there are times that the height of hedges does affect the adjacent property owners in terms of light and air and some controls are needed. In most cases when complaints_ are received the Zoning Inspectors issue an appropriate notice and some satisfactory solution is worked out between the property owners. There are, unfortunately, some of these complaints that cause bitterness between property owners and this places the City of Miami administration in an awkward position. However, enforcement of this regulation has not been a severe problem and I do not believe that any arbritary height figure limitation could be selected that would be acceptable in all cases. It is not my recommendation that the ordinance be changed.
