WHEREAS, the Plaintiffs filed an action against the City
of Miami and Police Officer William Smith (being Police Officer
William
Smylie), in the Circuit Court of Dade County, Florida,
bearing Number 73-2595, alleging that Roderick Bunyan was the
object
of excessive force and false arrest on or about March 12,
1972; and
WHEREAS, after considerable negotiation, counsel
tiffs has agreed to accept the sum of $1500.00 in full and
complete settlement of the cause;, and
WHEREAS,
the City Attorney

admission of liability, the sum of $1500.00 in full and complete
settlement of their claim against the City of Miami and Police

by Roderick Bunyan, a Minor, upon the execution of a Release
releasing the City of Miami

Plaintiffs, Eddie Runyan, Jr. individually and as father and next
friend of Roderick Runyan and Roderick Runyan, individually, filed
suit for personal injuries suffered by Roderick Buriyari. The suit
was filed against the City of Miami and police officer William Smylie.
it alleges malicious and false arrest arid assault and battery.
The plaintiffs stated in their deposition that on March 12, 1972
Roderick Bunyan, then 15 years old, was standing in his frontyard
talking with young friends. Their actions attracted the attention
of Officer Smylie and his partner. The officers made a u-turn,
returned to the Bunyan residence and proceeded to interrogate
Roderick Bunyan and his friends. Not being satisfied with the
information received from Roderick, Officer Smylie attempted to
place Roderick Bunyan under arrest. The tussle that ensued resulted
in Roderick suffering injuries on and about his face, for which he
was treated at Jackson Memorial Hospital.
Roderick Bunyan was not convicted of any charges placed against him
at that time. Officer Smylie obtained a warrant for the arrest of
Roderick Bunyan, alleging assault and battery upon himself, Officer
Smylie. No conviction resulted from these charges either
Eddie Bunyan, Jr., the father, was required to place bail to secure
his son's release in each instance.
Plaintiff Eddie Bunyan, Jr. is a respected high school principal
with 30 years tenure. He complained to Internal Security concerning
the handling of this case. The Internal Security investigation did
not result in disciplinary action.
After considerable negotiation with counsel for the plaintiffs, they
have agreed to accept the sum of $1500.00 in full and complete set-
tlement of this case.
I recommend this cas be settled for that amount, $1500.00.
