The Civil Service Board was apprised of the additional services being requested of
the University of Chicago's Industrial Relations Center relative to qualifying ap•
plicente for police Officers for employment with the City of #Miami.
Attached hereto is a copy of the Resolution passed by the Board at its meeting of
April 29, 1975 which, in effect, subscribes to and endorses the request for adr
dittonal services as outlined in that Resolution. You may be advised that I likewise
endorse the proposed new services and recommend that they be adopted as part of the
overall processing in the selection of Police Officers

the Industrial Relations Center, University of Chicago for a continuation of
the City of Miami's Police Testing. Program.
Representatives from Civil Service, the University of Chicago, and the Police
Department will be available at the City Commission meeting for any additional
information that might be necessary.
This agreement is in the process of being reviewed by the City Attorney.

WFIERFAS, the City Corrtrntssion by Resolution No. ) passed and
adopted on has authorised and directed the City Manager
to execute contracts and agreements in connection therewith; and
WHEREAS, the University has agreed that its department known as the
industrial Relations Center (hereinafter called ';Center") shall perform certain
services for the City of Miami Police Testing Program;
NOW THERt ''ORt, the City and the University for the considerations
hereinafter set forth, agree and covenant, one unto the other, as follows:
1) Services to be Performed The City and the university agree
that the Center shall perform the services hereinafter set forth
in connection with the City of Miami Police Testing Program.
Area Covered The Center shall perform all the necessary services
provided under this Agreement in connection with and respecting
the City of Miami Police Testing Program.
Scope of Services The Center shall exert its best efforts within
the time frame and budget allowances to perform and carry out,
in a satisfactory manner, as determined by the City Manager,
the services as outlined in the Scope of Services for the City
of Miami Police Testing Program, a copy being attached hereto
and made a part of this Agreement.
Data To Be Furnished to Center All information, data, reports
and records as are existing, available, and necessary for the
carrying out ofthe work shall be furnished to the Center without
charge by the City, and the City shall cooperate with the Center
in eery way possible in the carrying out of the planning work.
Time of Perforrna.nce The services of the Center are to commence
as soon as practicable after the execution of this Agreement and
shall be undertaken and completed in such sequence as to assure
their expeditious completion in the light of the purposes of this
Agreement, but in any event all of the services required hereunder

7) Niethod of Payment The University shall submit monthly bills
to the City showing the at iotints expended in performing the

according to the lane .item categories of the estimated budget,
which is attached as Payment shall be made by
the Pity within thirty days of receipt of each invoice. Provided,
however, the City may retain the final ten percent of the total
amount due to the University until the submission of the final
report.
Termination for Convenience
a) The performance of work under this Agreernent inay be
terminated in whole or from time to time iri part by the City
whenever for any reason the City shall determine that such
termination is in the best interest of the City. Termination
of work hereunder shall be effected by delivery in writing
to the University of a Notice of Termination specifying the
extent to which performance of work under the Agreement is
terminated and the date upon which such termination becomes
effective, such date shall be no sooner than. 30 days after
receipt by the University of the Notice of Termination.
b) After receipt of the Notice of Termination the University
shall cancel its outstanding commitmentshereunder covering
the procurement of materials, supplies, equipment, and
miscellaneous items. In addition, the University shall
exercise all reasonable diligence to accomplish the cancellation
or diversion of his outstanding commitments covering personal
services and extending beyond the date of such termination to
the extent that they relate to the performance of any work
terminated by the notice. With respect to such canceled
commitments the University agrees to (1) settle all outstanding
liabilities and all claims arising out of such cancellation of
commitments, with approval or ratification of the City to the
extent it may require, which approval or ratification shall be
final for all purposes of this clause, and (2) assign to the City
in the manner, at the time, and to the extent directed by the City,

any or all claims arising out of the termination of .such
orders arid subcontracts.
e) The University shall submit its termination claim to the
City promptly after receipt of a Notice of Termination.
d) The University and the City may agree upon the whole or
any part of the amount or amounts unts to be paid to the University
by reasori of the termination under this clause, which a.rnount
or amounts may include any reasonable cancellation charges
thereby incurred by the University and any reasona.bie loss
upon outstanding commitments tor personal services which
it is unable to cancel: Provided,:_ however, that in connection
with any o itstariditig commitments for personal services which
the University is unable to cancel the University shall have
exercised reasonable diligence to divert such commitments
to its other activities and operations. Any such agreement shall
be embodied in an amendment to this contract and the University
shall be paid the agreed amount.
e) The University agrees to transfer title to the City and
deliver in the manner, at the times, and to the extent, if
any, directed by the City, such information and items which,
if the contract had been completed, would have been required
to be furnished to the City, including:
1. Completed or partially completed plans, drawings,
and information; and
2. Materials or equipment produced or in process or
acquired in connection with the performance of the work
terminated by the notice.
f) If at any time the University finds itself in a position of
being unable to complete its obligations under this Agreement,
the University shall be free to so indicate in writing to the
City by providing, a Notice of Termination. Such termination
by the University shall be accomplished under the same
conditions as termination by the City, as indicated in sections
(a) through (e) of this clause.
:Changes The City Manager may, from time to time, request
changes in the :scope of the ,services to be provided by the
Center under this Agreement. If such changes are mutually
agreed upon with the Center, including any increase or decrease
in compensation, the City and the University shall incorporate
such changes in the Agreement by written. arnendrnetits. The
Center s1ta11 not be obligated to effectuate such changes unless
and until the written amendments have beet incorporated in the
Agreement.
10) Z'gua.,rripl.pyrnerkt Opportunity: `he University will not
discriminate against any employee or applicant for employment
because of race, color, religion, sex or national origin. The
University shall take affirmative action to ensure that applicants
are employed and that employees are treated during employment,
without regard to their race, color, religion, sex or national
origin.
11) 'Merest of eMembers of City and Others No officer, member or
employee of the City and no members of its governing body, and
no other public official of the governing body of the locality or
localities in which the Project is situated or being carried out
who exercises any functions or responsibilities in the review or
approval of the undertaking or carrying out of this Project, shall
participate in any decision relating to this Agreement 1,vhich
affects his personal interest or the interest of any corporation,
partnership, or association in whichhe is, directly or indirectly
interested or have any personal or pecuniary interest, direct or
indirect, in this Agreement or the proceeds thereof.
Interest of University The University covenants that it presently
has no interest and shall not acquire any interest, direct or
indirect, which would conflict in any mariner or degree with the
performance of services required to be performed under this
Agreement. The University further covenants that in the
performance of this Agreement no person having any such interest
shall be employ-ed.
13) Confidentiality and Publication Any reports, information, and
data given to the Center under this Agreement which the City asks
to be kept confidential shall not be made available to any individual
or organization without the prior approval of the City Manager.
The University also agrees that the release of information based on
the work done under this Agreement shall be in such form as to
protect the confidentiality of information with respect to individuals.
Reporrts, articles or viiiet materials pertaining, to the wort done

without ut the prior written approval of the City. l]'nwever, it is
understood that the University shall be free to publish the reStilt s

or related thereto, in such a manner as is consistent with goad
academic standards and practices. Sucli publication or other public
release shall respect corifidehtiality, but shell not require the
prior approval of the City. Copies of any publications will be
provided to the City prior to public release.
14) CopyrightNo material produced in part or in whole tinder this
Agreement shall be subject to copyright in the United States or in
any other country. The City shall have unrestricted, but not
exclusive, authority to publish, disclose, distribute, and otherwise
use, in whole or in part, any reports, data or other materials
produced under this Agreement. Provided that the City does not
publish materials of scholarly interest prior to their publication
by the University, unless prior approval has been obtained. In
providing rna.terial to the City the Center will indicate which
items are considered to be of scholarly interest, if any.
15) Office Space The City Manager hereby agrees, to maize available
without charge to the Center, either at the City's headquarters
or in a community or area 'receiving, assistance its usual place
of business for the performance of the services agreed to under
this Agreement, and the Center hereby agrees not to include any
charge for such additional space in its fee.

performance data remains within Year I. Tbe testing of incumbents using
the current recruit battery is planned for September 197$, and the conp1e.
tion of the statistical analysis b; December 1975.
2. Complete_: comvuter prog.ram,for test_interpretatio:t. This program
will interpret configurations of scores, as well as each part score sepa-
rately. This extension of the Year I computer program is expected to be
operational by October 1975. It is intended to provide the Miami' Police
Department with a more detailed picture of each recruit applicant than can
be represented by a siriple ranking on a not, in a form that requires a
minimum of professional assistance for interpretation This information
will be useful as part of the total selection process and, for applicants
actually selected, as part of the training/placement process within the
Department.
3. Review ("Validate") the total selection process. Paper -pencil
testing is not the only part of the recruiting and promotional process that
is subject to possible challenge as unfairly discriminatory. We propose to
devote the year from January through December 1976 to a thorough review of
the entire police selection process in Miami, wherever possible subjecting
this process to appropriate validation procedures. In December 1976, based
on this review, we will recommend the continuation or discontinuation of the
following components of the total process background investigation,' poly-
graph exam, medical exam, physical standards, agility tests, and the oral
interview.

will be rettuired these will be scheduled in August, 1ecerber, and April of
oach contract year. Up to 1000 applicants can be handled in each WO -day
period, by arranging two test sessions per day. A probable: saving of $2400
per administration from the stated budget can be realited by using local
personnel as exam proctors, as soon as the local "atmosphere" will permit.
The exact content of the recruit batterywill evolve Prot time to time, as
the results of the concurrent and longitudinal validation studies mature
and suggest improvements

such an examination has already been prepared, and is informally in circula-
tion. This examination should be scheduled for the earliest acceptable date
as soon as approval for this contract is assured, probably for November 1975.
This will be an "interim" job -knowledge examination only.
6. Develop and administer promotion exams for Sergeant and Lieutenant
These exams should be scheduled for February 1976, which is when the present
registers will expire. Any necessary book lists should be announced by
August 1975. It is intended that these exams will have the benefit of the
concurrent validation results, and that the total promotional selection pro-
cess probably will involve procedures in addition to job -knowledge testing.
7. Develop and administer promotion examsfor all three ranks. It is
our intent to move toward en annual cycle in which the group -testing aspects

of all three promotional examinations are scheduled within the same week,
probably in February of each year. The first such consolidated administra-
tion could core in 1977. Of course, any non -group aspects of the total pro-
motion process would continue to be desynchronized, and promotions would be
made as needed -throughout the year. By January 1977, both the concurrent
validation results and the review of the total selection process will be
available.

Proposed contract provision for the Miami Poll Project
In consideration of the acceptance of this contract, the City of
V ami understands that the Industrial. Relations Center will put forth its
best professional effort in the development of the tests and procedures,
but that the resulting "product" in no way guarantees that possible fut+are
governmental agency or court actions may not eventuate from their use.
While the Industrial Relations Center will, to the best of their ability,
aid the City of Miami in answering any agency investigatory charges or
court litigations, expenses incurred by the Industrial Relations Center
in doing this work will be invoiced to the City of Miami at cost, Such
charges might include, but not be limited to legal fees, staff time and
travel.
