WHEREAS, substance.. abuse has been defined as the
excessive or illegal use of drugs, narcotics, and other hallucina-
tory substances (not including alcohol) which have created
personal dependency on such substances; and
WHEREAS, the City Commission deems it advisable and in
the best interest of the inhabitants of the City of Miami to
establish an Advisory Committee on substance abuse as hereinafter
set forth;
NOW,, THEREFORE, BE IT ORDAINEDBYTHE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:.
Section 1. .There shall be established within the City
of Miami an Advisory Committee on Substance Abuse, as follows:
(a) Composition.
The Committee shall consist of : five
(5) members. Three members shall be persons having
expertise in the field of substance abuse and shall
be appointed by the City Commission. One member shall
be a professional planner employed by the City. of Miami
in its Planning Department_ and shall be appointed by
the Director of the Planning Department. One member
shall be an:empinyee of the City. of Miami Building
Department and shall be appointed by the Director of,
the Building Department.
(b) Term of Office.
All members shall be appointed for a
two (2) year period and shall serve without compensation,''
except those members who are regular employees of the
City of Miami who shall receive compensation at their
normal rate of pay. The first terms of office shall
commence when the final appointment to the Board is made.'`
(c) Purpose and Responsibility.
Tl Committee shall review the operations
and objectives of , each proposed substance abuse program
in termsof location, land use, building, and other
standards adopted for substance abuse facilities as
contained in Section 43, Article IV, of the Comprehensive
Zoning Qrdina we and to maSe recommendations to 'the City
Administration, 4onin9 Poard and City Commission per -
'Wining to those standards.

Meetings shall be called as bedessafy
by the iiredtor of the 'bepatttttent of AdMinistration
for planning and Zoning Boards. All meetings shall

shall be Rept as a permanent part of the Zoning. Board
file foran application for Conditional use, ot.
permanent part of , the Building Department' file if
no Conditional use approval is required.
Section 2, All laws.or parts of laws in Conflict
herewith be, and the same are hereby repealed insofar as they
are in conflict.
Section 3. If any section, sentence clause, phrase,•
or word of this Ordinance is for any reason held or declared to
be unconstitutional, inoperative or void, such holding or
invalidity shall, not affectthe remaining portions of this

Ordinance, and it shall be construed to have been the intent of
the Commission of the City of Miami to pass this Ordinance without
such unc
onstitutional, invalid, or inoperative part therein; and
the remainder of this Ordinance after the exclusion of such part
or parts shall be deemed to be valid as if such parts had not been
included therein.`
Section 4. This ordinance is hereby declared to be an
emergency measure on the ground of urgent public need for the
preservation of peace, hoalth, safety and property in the City o
Miami.
Section 5. Tno requirement of reading this ordinance
on two separate days is hereby dispensed with by a vote of not
loss than four -fifths of the members of the commission. .
Section 6. The provisions of this ordinance shall
become effective immediately upon passage.

The attached Ordinance is a procedural Ordinance and there
is no requirement for consideration by the Planning Advisory
Board. The Ordinance sets up an Advisory Committee on
Substance Abuse and provides for its composition, term of
office, purpose and responsibilities, conduct of meetings and
report and recommendations. It may be properly considered with
the five Substance Abuse Ordinances that are being recommended
by the Planning Advisory Board.
The attached Ordinance is being recommended by the City Manager.
