County Court No. 74-1814-CC i05
(Resolution)
On October 4, 1975, after a two-day trial in the County Court,
a Final Judgment was entered in the above cause on a verdict in
favor of the Plaintiffs, Edgar Dixon, L. A. Bush and Felton Madison,
and against the City of Miami, in the amount of $800.00 for each
Plaintiff, totalling $2400.00.
This case was based on an alleged false arrest and charges of police
brutality during a riot situation. The arrest was made by City of
Miami police officers in the City of Coral Gables. Coral Gables
settled out of court prior to the trial.
Assistant City Attorney Montague Rosenberg succeeded in having the
case transferred to the County Court, thereby reducing obtainable
damages.
After considerable negotiation with the attorneys for plaintiffs, a
flat settlement of $1,000, including their costs of $662.00, is
acceptable in settlement of the claim and in satisfaction of the
$2400 final judgment against the City of Miami.
Accordingly, I recommend that the City of Miami satisfy the final
judgment of $2400, including costs of $662.00, for the sum of $1,000
in full and complete settlement of the cause, thereby closing the case.
