HomeMy WebLinkAboutR-75-0325RESOLUTION NO, 75-325 A RESOLUTION AUTHORIZING AIID DIRECTING THE DIRECTOR OF FINANCE TO PAY TO EDGAR DIXON, I„ A, BUSH AND FELTON MADISON, AND HAROLD BRONSTEIN AND R, JEROME SANFORD, THEIR ATTORNEYS, THE SUM OF $1,000 IN FULL AND COMPLETE SATISFACTION OF THE FINAL JUDGMENT OF $2400 AGAINST THE CITY OF MIAMI IN THE COUNTY COURT, CASE NO. 74-1834-CC-05, IN- CLUDING THEIR COSTS OF $662.00 IN THE ABOVE SUIT, DUE TO AN ALLEGED FALSE ARREST IN CORAL GABLES ON FEBRUARY 22, 1971 DURING A RIOT SITUATION, WHEREAS, Plaintiffs, Edgar Dixon, L. A. Bush and Felton Madison, a Minor, by his next friend Robert Madison, filed a suit against the City of Miami and its police officers on December 3, 1971, alleging false arrest and police brutality in Coral Gables on February 22, 1971 during a riot situation; and WHEREAS, said cause, after a two-day trial in County Court, resulted in a final judgment being entered on October 4, 1974 on a verdict in favor of the above plaintiffs and against the City of Miami in the amount of $800.00 for each plaintiff, totalling $2400.00 plus costs, in Case No. 74-1834-CC-05; and WHEREAS, after considerable negotiation between the parties and their attorneys, said parties are willing to accept a flat settlement of all damages and costs, which are in the amount of $662.00, for the sum of $1,000 in full satisfaction of the Final Judgment entered October 24, 1974 in the above litigation; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the Director of Finance is hereby authorized and directed to pay to EDGAR DIXON, L. A. BUSH AND FELTON MADISON, AND IIAROLD BRONSTEIN AND R. JEROME SANFORD, THEIR ATTORNEYS, the sum of $1,000 in full and complete satisfaction of the Final Judgment dated October 24, 1974 in County Court Case No. 74-1834-CC-05, including costs of $622.00, thereby closing the entire case. County Court No. 74-1814-CC i05 (Resolution) On October 4, 1975, after a two-day trial in the County Court, a Final Judgment was entered in the above cause on a verdict in favor of the Plaintiffs, Edgar Dixon, L. A. Bush and Felton Madison, and against the City of Miami, in the amount of $800.00 for each Plaintiff, totalling $2400.00. This case was based on an alleged false arrest and charges of police brutality during a riot situation. The arrest was made by City of Miami police officers in the City of Coral Gables. Coral Gables settled out of court prior to the trial. Assistant City Attorney Montague Rosenberg succeeded in having the case transferred to the County Court, thereby reducing obtainable damages. After considerable negotiation with the attorneys for plaintiffs, a flat settlement of $1,000, including their costs of $662.00, is acceptable in settlement of the claim and in satisfaction of the $2400 final judgment against the City of Miami. Accordingly, I recommend that the City of Miami satisfy the final judgment of $2400, including costs of $662.00, for the sum of $1,000 in full and complete settlement of the cause, thereby closing the case.
