HomeMy WebLinkAboutR-75-0324RESOLUTION NO. 75-324 A RESOLUTION AUTHORIZING AND DIRECTING THE DIRECTOR OF FINANCE TO PAY TO LEROY ALVIN DORSETT, BY HIS MOTHER AND NEXT FRIEND, LILLIE MAE DORSETT, WITHOUT THE ADMISSION OF LIABILITY, THE SUM OF $2500.00 IN FULL AND COMPLETE SETTLEMENT OF TIiEIR CLAIM AGAINST THE TWO POLICE OFFICERS OF THE CITY OF MIAMI, AS AGREED TO IN OPEN COURT BY THE PARTIES, THE JUDGE AND THE RESPECTIVE COUNSEL. WHEREAS, LEROY ALVIN DORSETT, by his mother and next friend, LILLIE MAE DORSETT, filed suit against the City of Miami, Mayor Ferre, the Police Chief and two police officers of the City of Miami on July 3, 1973, alleging that the minor plaintiff had been severely beaten while handcuffed and prisoner in a City of Miami police van at the Orange Bowl game on August 12, 1972; and WHEREAS, all but the two police officers were eliminated from the case prior to trial, and at the trial, with the consent of the Police Chief and others, the City agreed in order to save the expense of litigation, to settle the case and withdraw the issue from the jury for the sum of $2500.00 in accordance with the presiding Federal Judge's request; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the Director of Finance is hereby authorized and directed to pay to LEROY ALVIN DORSETT, BY HIS MOTHER AND NEXT FRIEND, LILLIE AAE DORSETT, the sum of $2500.00, without the admission of liability, in full and complete settlement of their claim against the two City of Miami police officers, thus completely closing the case as to the City of Miami and its officers, agents and employees. No. 73-1129-CIV4-JLit (Resolution) On July 3, 1973, Plaintiff filed suit against Mayor Ferre, the City of Miami, the Police Chief and two police officers. At the time of the incident complained of the minor Plaintiff was 17 years of age. The facts declared on indicate that the minor Plaintiff, while handcuffed and a prisoner in a Miami police van, was severely beaten by two off -duty Lauderhill policemen. The minor Plaintiff complained of cuts, lacerations about the mouth, nose and face, and an injured left arm and left rib -cage. This occurred on August 12, 1972 at an Orange Bowl game in the City of Miami. All defendants but the two police officers were eliminated from the case prior to trial, and at the trial, with the consent of the Police Chief and others, the City agreed, in order to save the expense of litigation, to settle the case and withdraw the issue from the jury for the sum of $2500.00, in accordance with the presiding Federal Judge's suggestion. I, accordingly, recommend to the City Commission that the sum of $2500.00 be paid to Leroy Alvin Dorsett, by his mother and next friend, Lillie Mae Dorsett, in full and complete settlement of their claim, without the admission of liability, against the two police officers of the City of Miami, thereby completely closing the case as to the City of Miami, and its officers, agents and employees.
