W, Andrews City Manager NEB 2 0 13?5 • Motion concerning Proposed I2-CC (Residential -Office) District: Planning, Advisory 13oard Public hearing January 8, 19.3 This memorandum transmits a concern of the Planning Advisory Board and requests the Commission's deter- mination of the disposition of the proposed R-CC District (Residential -Office). On November 6, 1974, the Planning Advisory Board in public hearing, upon the recommendation of the Planning Department, recommended a new R-CC District (Residential -Office), as an amendment to the Comprehensive Zoning Ordinance to the City Commission (Resolution PAB 79-74). At the meeting of December 2, 1974, the City Commission deferred considera- tion of the Planning Advisory Board recommendation concerning a new R-CC District (Residential -Office) until the properties to which the ne;.v district would apply were before you. On January 8, 1975, the Planning Advisory Board in public hearing, considered the Planning Department's recommendation that the proposed 1:-CC District (Residential -Office) be applied to certain properties in Coconut Grove. The Planning Advisory Board took the position that they had insufficient knowledge of the final provisions of the R-CC District, as it would be approved by the Commission, and voted to defer the item, as follows: RESOLUTION NO. PAB 4-75 RESOLUTION RECOMMENDING DEFERRAL OF THE APPLICATION OF R-CC ZONING TO THE THREE DISTRICT AREAS OF S. W. 27th AVENUE, AVIATION AVENUE AND GRAND AVENUE, AND FURTHER RECOMMENDING THAT TIIE PROPOSED 11-CC AMENDMENT TO THE COMPREHENSIVE ZONING ORDINANCE BE ACTED UPON BY TIIE CITY COM- MISSION AND INCORPORATED AS A PART OF THE COMPREHENSIVE ZONING ORDINANCE PRIOR TO Se-e- Page 1 of 2 PE8 2 o 075 Honorable i\Eetribers of the City Commission 'I'IIE PLANNING ADVISORY BOARD MAKING A P.ECOMMENDA'i'ION ON TETE APPLICATION OF THE R-CC CLASSIFICATION TO SPECIFIC PROPER TIES, Further, the Planning Advisory Board passed the following motion: MOTION: Motion questioning the procedure of recommending the application of a district without knowledge of the provi- sions of the district which is pending approval by the City Commission and forwarding to the City Commission a memorandum setting forth the reasons for the Planning Advisory Board's deferral of the R-CC District as set forth in Resolution No. PAB 4-75. This matter was also discussed by the Planning Advisory Board in the meeting of February 5, 1975, with no resulting action. In summary, the Planning Advisory Board and City Commission have reached a stalemate, concerning the R-CC District in which neither body is prepared to act. RECOMMENDATION: Ninety (90) days have expired, by which time the City Commission must act on a Planning, Advisory Board recommendation or it is considered denied. (Ordinance 8197, Section 13 dated October 4, 1973.) Therefore the administration recommends that Resolution PAB 79-74 of November 6, 1974, recommending the proposed R-CC District (Residential - Office) be returned to. the Planning Advisory Board for further hearings with . specific instructions as to how the City Commission expects the Planning Advisory Board to act on new ronirtg districts and the application of the zoning district to specific parcels of land. Accordingly, this matter will be scheduled on the March 12, 1975, City Commission Meeting Agenda. Page 2 of 2
