WHEREAS, the Miami City General EmployeesRetirement.
Plan (Ordinance No. 5624, May 2, 1956, as amended) was not includ-
ed as a portion of the new Code of the City of Miami, Florida,
effective September 1, 1967, as adopted by Ordinance No. 7565
(July 25, 1967); and
WHEREAS, said plan now exists in codified form as it
appears in Chapter 2 of the Code of the City Of Ui.ami, Florida, 1957,
as: mended, in addition to basi.t ordinance. form; and
WHEREAS, any addition or amendments to said plan oan f n'.s

WHEREAS, it is the desire of the City .o.E Miami City
Commission to . implement the provisions of such agreements;
NOW, .THEREFORE, BE IT ORDAINED }3Y THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The Miami City General Employees' Retire-
ment Plan (Ordinance. No. 5624, rlay 2, 1955, as amended) as said
ordinance, as amended, appears in codification fort as a part of
Chapter 2 of the. Code of the City of Miami, Florida, 1937, as amen-
ded, is hereby amended by creating a Subsection (3) of Section 109,
Elt ' �Jt.' i�L;�fi"ti, I' .Otit1as as
utilizing existing provisions of Section 109 and lettering said
provisions respectively (a), (b) and (c), and by adding a new
paragraph (d) to Subsection (3) of Section 109 of Chapter 2, which
shall read as follows:
(3)
(a) Upon such retirement, if he has three (3)
or more years service since last becoming a
member, he shall also receive a pension equal
to one (1) per cent of average final compen-
sation for each year of service or fraction
thereof that such member served as the city
manager, assistant city manager, city clerk,
executive secretary of the Civil Nervice Board,
) ecutive secretary of the Planning and Zon-
ing t3oard, city physician, city attorney, as-
sistant director of the Department of Law or
as director or assistant director of Ft depart-
ment established by the Charter of the city or
._ by ordinance as authorized by such Charter;
provided, that he has served in any of such
capacities for 4 tota], combined pariod of ►lot

In addition, upon reaching minimum service
retirement age and upon such retirement if a
member hasserved in the capacity of city
manager, as provided in Article XV of the
City Charter, or as city attorney, as provided
in Article XXI of the City Charter, and who
has served in such capacity for a period of
not less than ten (10) years since last becom-
ing a member, he shall also receive a pension'
equal to an additional ten (10) par cent of
average final compensation; provided, however,
that such member is not otherwise eligible,
for such ten (10) per cent of average final
compensation as set forth under the require-
ments and provisions of Ordinance No. 8044,
passed March 16, 1972.
(d) Any employee who was a member of the Retire-
ment Plan prior to October 1, 1974, or who
was a General Ernolovee who was transferred from
the Retirement System to the Retirement Plan
Shall have the o,tion of having his retirement

if such member Qualifies, ' he may have his
benefits computed in accordance with the

and it shall be construed to have been the intent of the Commis-,
sion of the City of Miami to pass this ordinance without such un-
constitutional, invalid or inoperative part therein; and the re-
mainder of this ordinance after the exclusion of such part or parts
shall be deemed and held to be valid as if such parts had not
been included therein.

an emergency measure on the ground of urgent public need for the
preservation
