WHEREAS, the City of Miami has, entered into agreements
with the General Employees' Association; the Sanitation Employees'
Association; and the Miami, Florida, City EmployeesLocal 654,
American Federation of State, County, and Municipal Employees,
AFL-CIO; and
WHEREAS,, the subject agreements provide for changes
to be made with regard to the administration of the Retirement
Plan; and
WHEREAS, it is the desire of the City of Miami City
Commission:to implement the provisions of the subject agreements
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF,
THE CITY. OF.MIAMI, FLORIDA:
Section 1. ,The Miami City Employees' Retirement Plan
(Ordinance No. 5624, May 2, 1956, as amended) as said ordinance,
as amended, appears in codified form, as part of Chapter 2 of
the Code of the City of Miami, Florida, as amended, is,
hereby amended by repealing Section 2-108, entitled "Adminis-
tration" and substituting, therefore, a new Section 2-108, en-
titled "Administration", which shall provide as'follows:
Section 2108. Administration
(1) Thegenera1 administration and responsibility
for the, operation Of the Retirement Plan shall
be vested in a board consisting of nine (9)

petsons) as follows: four (4)persons elected by
the iettbefship of the Retirement Plan; one (l)
city tanager; one (1) director of finance; tWo (2)
iletttbefs of the city administration, appointed
by the city friafiager; and one (l) City Coto italer
appointed by the Gity Commission. The it coatis
signer so appointed shall serve only.fot such
time as he remains a City commissioner.
(2) The first Meeting of the board created herein shall
taRe place Within 30 days from the date ptovid-
itg fot the election of members to said board as
hereinafter provided.
The procedure for electing members to the Retiree
ment Board shall be similar to the procedure used
for the election of members to the Civil Service
Board of the City of =Miami . Each member ' s term
of office shall be for two (2) years. The first
election shall be held within 45 days from the
effective date of the ordinance creating the Re-
tirement Board of the Miami City General Employees'
Retirement Plan wherein two (2) members shall be
elected by the membership of the Retirement Plan
for a term ending on December 31, 1976. The two (2)
members of the Retirement Plan who currently serve
on the Retirement Board shall be members of the
board herein created until December 31, 1975.
Those members who are to be appointed to the Re-
tirement Board by the City Commissionand by the
city manager shall be appointed within 45 days
from the effective date of the ordinance creat-
ing the Retirement Board of the Miami City General
Employees' Retirement Plan. Elections shall take
place between December 1 and December 15 of each
year wherein two (2) members elected by the mem-
bership of the Retirement Plan shall be elected
for a term of two (2) years, commencing January 1
and terminating two (2) years thereafter on De-
cember 31.
(4) If a vacancyoccurs in the office of an elected
member, the vacancy shall be filled for the.'un-
expired. term in the same manner and in accordance
with the same provisions for election of members
to the board.
(5) The board members shall serve without compensation.
(6) Each member shall take an oath of office within
ten (10) days after his appointment or election.
Each member of the board shall be entitled to one (1)
vote. Five (5) concurring votes Shall be neces-
sary for a decision by the members of the board
and five (5) members shall constitute a quorum
of the board.
Subject to the limitations herein contained,
the board may from time -to -time establish such,
rules and regulations as may be necessary for the
eff.cient administration of the system.

such actuarial medical and other services
as shall be required:
(10) The board shall keep it convenient fotm such
data as shall be necessary for actuarial
evaluation of the various funds of the Re=,
tiremeht Plan and E'or checking the ef;petience
of the Retirement Plan.
(11) The board shall keep a record of all of its
proceedings which shall be open to public
inspection.The minutes of the Retirement
Board shall reflect a complete and compre-
hensive account of the discussions and actions
taken by the Retirement Board.
(12) The board shall submit to the City Commission
annually a report showing the fiscal trans-
actions of the Retirement Plan for the year
ending on the preceding December 31st, the.
amount of the accumulated cash and securit-
ies of the plan and the last balance sheet
showing the financial condition of the plan
by means of actuarial valuation of the assets
and liabilities of the plan. Said information
and reports shall be submitted to the City
Commission no later than July 1st of each
year.
(13) The board shall designate an actuary whoshall
be the technical advisor of the board in mat-
ters regarding the operation of the funds crea-
ted by the provisions of this section, and.
shall perform such other duties as are required
in connection therewith.
(14) The city attorney shall be the legal advisor
of the board.
(15) The Retirement Board shall designate one (1)
physician who shall assist the board in the
performance of its duties. Each applicant
for disability retirement shall be referred
to said physician for examination, evaluation
and report. Such physician shall be auth-
orized to refer the applicant to a special-
ist or specialists at his discretion from a
list approved by the board. saidspecialist
or specialists shall report their findings and
conclusions to the physician in writing. Said
physician shall arrange for and pass upon
all medical examinations required under the
provisions of this section and, after taking
into consideration the reports of the special-
ists, if any, shall report his conclusions
and recommendations to the board in writing,
(16) At least one (1) in each three (3) year period
the board shall cause an actuarial investigation

Section 2. All crdinances, code sections or parts thereof
it conflict herewith, insofar as they are in conflict, ate hereby
repealed.
Section 3. If any section, sentence, clause, phrase
or word of this ordinance is
for any reason held or 'declared to
be unconstitutional, inoperative or void such holding or invalid
ity shall not affect the remaining portions of this ordinance; and.
it shall be construed to have been the intent of the Commission of
the City of Miami to pass this ordinance without such unconstitutional,
invalid or inoperative part therein; and the remainder of this or-
dinance after the exclusion of such part or parts shall be deemed
and held to be valid as if such parts had not been included therein.
Section 4. This ordinance is hereby declared
to be an
emergency measure on the ground of urgent public need for the pre-
servation of peace, health, _safety and property in'the City of. Miami.
Section 5. The requirement of reading this ordinance
on two separate days is hereby dispensed with by a vote of not less
than four -fifths (4/5) of the members of the Commission.
