WHEREAS, ARTICLE XXXI, Section 3(2) of Ordinance . 6871, the Comprehensive Zoning Ordinance for the City of 15 Miami permits an extension of a variance by the City Manager, 16 with approval by the City Commission, for a period of one year; 17 18 19 OF THE CITY OF MIAMI, FLORIDA: NOW, THEREFORE, BE IT RESOLVE]5 BY THE COMMISSION "DOCUMENT INDEX ITEM NO 1- Section 1. The request for a one year extension 20 of the variance granted on the property at 10 N.E. 40th 21 Street, by Zoning Board Resolution No. ZB 134-74, as per 22 Ordinance No. 6871, Article XVII, Section 6 and Article XXIII, 23 Section 4 (27), to permit construction of building with a 2.5 24 floor area ration (2.0 permitted), and waiving 4 of 23 parking 25 spaces, as per plan dated 9/5/74, on Lots 21, 22, 23 and 24, all 26 less E5', Block 3, COMMERCIAL BILTMORE AND (6-131), building to 27 be used for furniture wholesale showrooms; zoned C-5 (Liberal 28 Commercial) District, be and the same is hereby granted. 29 30 31 32 PAS rc( H . XVII, Section 6, and ART. XXIII, Section 4 (27), to permit construction of building with a 2.5 Floor Area Ratio(2.0 permitted), and waiving 4 of 23 parking spaces, as per plan dated 9/5/74; on Lots 21, 22, 23, and 24, all less E5', Block 3, COMMERCIAL BILTMODE AND (6-131) , at approximately 10 N. E. 40th Street; building to be used for furniture wholesale showrooms; zoned C-5 (Liberal Commercial) . Ord. 6871, ART. XXXI, Section 3, permits the City Manager, with approval by the City Commission, to extend the effective period (6 months) of a Variance by an additional period of tine not to exceed one year. Mr. A. Rudd Cutler, for the applicant in this matter, has requested that such an extension be granted. It is suggested that this matter be placed on an early Commission agenda. The notice he received indicated that the variance would expire on March 9, 1975 but that application for a one year extension could he made through you subject to the approval of the City Commission. My client requests you to grant such an extension for a period of one year from March 9, 1975. He has not abandoned his plan to go forward with the wholesale furniture showroom project but the current conditions especially those relating to the unavailability of adequate mortgage financing make it impossible to go forward with the project at this time.
