OF THE VARIANCE GRANTED ON THE PROPERTY AT
10 N.E. 40TH STREET BY ZONING BOARD RESOLUTION
NO, ZB 134-74, AS PER ORDINANCE NO, 6871,
ARTICLE XVII, SECTION 6, AND ARTICLE XXIII,
SECTION 4 (27), TO PERMIT CONSTRUCTION OF BUILD-
ING WITH A 2.5 FLOOR AREA RATIO (2,0 PERMITTED),
AND WAIVING 4 OF 23 PARKING SPACES, AS PER PLAN
DATED 9/5/74; ON LOTS 21, 22, 23 AND 24, ALL
LESS E5', BLOCK 3, COMMERCIAL BILTMORE AND
(6-131), BUILDING TO BE USED FOR FURNITURE

WHEREAS, ARTICLE XXXI, Section 3(2) of Ordinance
. 6871, the Comprehensive Zoning Ordinance for the City of
15 Miami permits an extension of a variance by the City Manager,
16 with approval by the City Commission, for a period of one year;

Section 1. The request for a one year extension
20 of the variance granted on the property at 10 N.E. 40th
21 Street, by Zoning Board Resolution No. ZB 134-74, as per
22 Ordinance No. 6871, Article XVII, Section 6 and Article XXIII,
23 Section 4 (27), to permit construction of building with a 2.5
24 floor area ration (2.0 permitted), and waiving 4 of 23 parking
25 spaces, as per plan dated 9/5/74, on Lots 21, 22, 23 and 24, all
26 less E5', Block 3, COMMERCIAL BILTMORE AND (6-131), building to
27 be used for furniture wholesale showrooms; zoned C-5 (Liberal
28 Commercial) District, be and the same is hereby granted.

Extension of Variance
On September 9, 1974, the Zoning Board granted a variance
by Resolution ZB-134-74 as follows:
Resolution to grant a variance from Ordinance No, 6871, ART.
XVII, Section 6, and ART. XXIII, Section 4 (27), to permit
construction of building with a 2.5 Floor Area Ratio(2.0
permitted), and waiving 4 of 23 parking spaces, as per plan
dated 9/5/74; on Lots 21, 22, 23, and 24, all less E5', Block
3, COMMERCIAL BILTMODE AND (6-131) , at approximately 10 N. E.
40th Street; building to be used for furniture wholesale
showrooms; zoned C-5 (Liberal Commercial) .
Ord. 6871, ART. XXXI, Section 3, permits the City Manager,
with approval by the City Commission, to extend the effective
period (6 months) of a Variance by an additional period of
tine not to exceed one year.
Mr. A. Rudd Cutler, for the applicant in this matter, has
requested that such an extension be granted. It is suggested
that this matter be placed on an early Commission agenda.
'The Law Department, by a copy of this memo, is being requested
to provide the proper Resolution.

Dear Mr, Andrews:
I represent Mr. Irving Kane, who by resolution dated September 9, 1974
and numbered ZB134-74, received a variance in connection with a certain
property which is located at approximately 10 N.E. 40 St., Miami, Fla.
The notice he received indicated that the variance would expire on
March 9, 1975 but that application for a one year extension could he
made through you subject to the approval of the City Commission.
My client requests you to grant such an extension for a period of one
year from March 9, 1975. He has not abandoned his plan to go forward
with the wholesale furniture showroom project but the current conditions
especially those relating to the unavailability of adequate mortgage
financing make it impossible to go forward with the project at this
time.
Your kind cooperation in granting the requested extension will be greatly
appreciated. I look forward to your early advice concerning this matter.
