HomeMy WebLinkAboutR-75-0173RESOLUTION NO, _...75.. 73_.._: A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER AND THE CITY CLERK TO ENTER INTO A CONTRACT WITH PHIL HAMMERSMITH FOR SERVICES AS ADMINISTRATIVE ASSISTANT TO THE MAYOR OF THE CITY OF MIAMI FOR A PERIOD OF ONE YEAR COMMENCING ,I=.L� 1975, COMPENSATION FOR SAID SERVICES TO BE $12,000,00 PER YEAR, SUBJECT TO THE TERMS AND CONDITIONS CONTAINED IN THE CONTRACT ATTACHED HERETO. WHEREAS, it is deemed to be in the best interest of the people of the City of Miami the,City of Miami of his duties for that an Administrative Assistant to the mayor of be established to aid the Mayor in the performance and on behalf of said people of the City of Miami; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the City Manager and the City Clerk are hereby authorized and directed to enter into a contract with PHIL HAMMERSMITH for his services as Administrative Assistant to the Mayor of the City j :.. ,tu/97f' of Miami for a period of one year commencing March-1.,-1975 at a com- pensation of $12,000.00 per year, subject to the terms and conditions contained in the contract attached hereto. Section 2. That the proper officials of the City of Miami be authorized to allocate the sum of $12,000.00 from the proper fund to effectuate the provisions of this contract. MAF:mp 3 .1 ?#; it L DDCUMENTS 01 LOW 11 Z/ Z7-14' eel": AG,...R E_._EMM E_ NT THIS AGREEMENT made and entered into this day of , 1975, by and between THE CITY OF MIAMI, a municipal corporation located in Dade County, Florida, hereinafter referred to as the "City", and PHII, HAMMERSMITH, hereinafter referred to as the "Administrative Assistant to the Mayor": W ITNESSET H: WHEREAS, the City Commission has recommended that an Administrative Assistant to the Mayor be established; and WHEREAS, the Commission of the City of Miami adopted Resolution No. on , authorizing the entering into of an agreement between PHIL HAMMERSMITH and THE CITY OF MIAMI, wherein PHIL HAMMERSMITH would be retained as Administrative Assistant to the Mayor; NOW, THEREFORE, in consideration of the mutual covenants and agreements hereinafter set forth. the parties hereto covenant and agree as follows: 1. The term of this contract for the services of the Administrative Assistant to the Mayor shall be for a period of one year commencing March 1, 1975, subject to the right of either party hereto to cancel this contract upon giving thirty (30) days prior written notice. 2. The Administrative Assistant to the Mayor shall receive compen- sation for his services at the rate of $12,000.00 per year with deductions for Social Security and Federal Withholding Taxes payable in equal bi-weekly installments. 3. In the event either party cancels this contract, the compen- sation shall be paid only to the effective date of cancellation. 4. The Administrative Assistant is entitled to he paid sick leave not to exceed a total of twelve (12) days during the period of this agreement. 5, The Administrative Assistant to the Mayor shall be entitled to two weeks' vacation from the duties prescribed in this contract and shall be paid according to the regular bi-weekly payment of compensation during such vacation period after he has compieted one (1) year's employment as herein- after set forth, "SUPPORTIVE DOCUMENTS FOLLOW" 6, The Administrative Assistant to the Mayot shall accrue no Civil Service tights or privileges, and shall have to emoluments of office except as expressly contained in this contract. 7. The Administrative Assistant to the Mayor shall not be a part of the Pension System of the City of Miami, nor shatl he accrue any rights or privileges in the Pension System of any type or nature whatsoever. S. The Administrative Assistant to the Mayor shall perform such duties as herein prescribed, and he shall devote his entire time and attention to said duties, and shall not engage in any other business or profession. 9. The Administrative Assistant to the Mayor shall be wholly responsible to the Mayor of the City of Miami and shall serve at his will and pleasure. 10. The Administrative Assistant's duties shall include the following: (1) Receive on behalf of the Mayor inquiries or complaints from private citizens. (2) Prepare at the direction of the Mayor letters, memoranda, or other documents as may be required by the Mayor. If the Mayor desires, these may be prepared for the Mayor's signature. In the event the Mayor directs or authorizes the Administrative Assistant to affix his signature to any letter or document, the Administrative Assistant will indicate that he has affixed the Mayor's signature by placing his initials beside the signature of the Mayor that he has affixed. to the letter or document. (3) Represent the Mayor at public meetings only when requested to do so by the Mayor. In such case when the Administra- tive Assistant is representing the Mayor at any public meeting, the Administrative Assistant shall make no representation of any kind whatsoever which could be considered by any person or other official at the public meeting to obligate the City in any fashion. it a t i • Ali,,..,... r OLEif. (4) Make trecessary arrangetnents for the Mayor involving appointments. (5) Perform such other duties which may be specifically directed by the Mayor. 11, The Administrative Assistant to the Mayor shall have no authority, control or direction over any officer, employee or department of the City of Miami. 12. The Administrative Assistant to the Mayor shall not enter into any written contracts, documents or legal instruments or make any oral representations that bind or obligate the City of Miami. 13. The provisions regarding conflict of interest in Section 4(c) of the Charter of the City of Miami and the provisions of the conflict of interest ordinance of the City of Miami (Article V, Sections 2-101, 102, 103, 104 and 105 of the Code of the City of Miami) are applicable to the Administrative Assistant and he shall be bound by these provisions. 14. In the event of cancellation of this contract by either party hereto, the aforementioned thirty (30) days' notice of such cancellation shall be given in writing addressed to the other party as follows: City Manager P.
