WHEREAS, the Miami City Employees' Retirement System
and the Miami City General Employees' Retirement. Plan (Ordinance
No. 2230, Deceml-er 6, 1939, and Ordinance No. 5624, May 2, 1936,
as amended) were not included ns a portion of the ne': Coca of
the City of Miami, Florida, effective September 1, 1H 67, is
adopted by Ordinance No. 7585 (July 25, 1967); and
WHEREAS, said system and plan now exist in r.ha ccd if ied
form as they appear in Chapter 2 of the Code of the Cit • cn ian 1,
Florida, 1957, as amended, in addition to basic ordinance

WHEREAS, pursuant to the agreements herein alluded
to, it is provided that the return of contributions which a
tnember
is entitled to upon receiving an accidental disability
retirement shall cease; and
WHEREAS, it is the desire of the City of Miami City
Commission to implement the provisions of the subject agree-
ments;

Section 1. The Miami City Employees' Retirement
System (Ordinance No. 2230, December G, 1939, as amended) a.;
said ordinan':e, as amended, appears in codified form, as pert
of Chapter 2 of the Code of the City of Miami, Florida, as
amended, is hereby amended by repealing Sub action (10) or

and substituting therefor a new. Subsection (1) of Section 2-1
which shall provide as follows
RETURN Or CONTRIBUTION
Should a memberin Grout, 1, 2,..3 or 4 cease to
be an e;nploee L ne shall., be ,'paid on demand the sum
of his contributions, together with such interest
theteon, not less than thre uartets (3/4). o.f ac-
cumulated rre ular interest, as the board shall al-
low,, with the following exceptions:
1. Anv member who has been granted aril retire-
ment whatsoever shall not be entitled to a return
of his or her contributions, unless the memberLa
eligible for the benefits of option 6(a) under
Section 2-91(14) which provides for a return o
contributions; or in the event a member is entitled
to a return of excess contributions under Section 2-91(2)(cL.
There shall be no return of contributions to any
persons entitled to receive an accidental disabil-
ity retirement allowance. Nothing herein shall
be construed to deprive the spouse of a deceased
member to his or her ordinary death benefit or
accidental death benefit hereinabove set forth.
2. In the event of the death of and member, _ there
shall be.noreturn of contributions, unless a mem-
ber in Groun 1, 2, 3 or 4 died in service. In such
event, the contributions shall be payable to such
persons, if any, as he shall have nominated bj
written designation duly executed and filed with
the board, otherwise to his legal representative;
provided that such amount may, with the approval
of the board, be paid in the sum of an annuity
at the option of the beneficiary.
Section 2. The Miami City General Employees' Retirement
Plan (Ordinance No. 5624, May 2, 1956, as amended) as said or-
dinance, as amended, appears in codified form as a part of Chap-
ter 2 of the Code of the City of Miami, Florida, 1957, as amended,
is hereby amended by repealing Subsection (9) of Section 2-109
which provides as follows; 1

RETURN OF CONTRIBUTIONS
Should a :member cease to be an employee, he shall
be paid on demand the sum of his contributions,
togetherwith such interest thereon, not less
than three-quarters C1/4) of accumulated regu-
lar interest, as the board shall allow, with
the folloWLtq exceptions:
1. Any member who has been granted any retire-
ment whatsoever, shall not be entitled to a
return of his or her contributions, unlesa the
member is eligible for the benefits of option 6
under Section 109(14), which provides for a
return of contributions; or in the event a mem
ber is entitled to a return of excess contribu-
tions under Section 2-109 (2) (f) .: Thera shall

if such parts had not been i.ncjuced therein
Section 5. This Ordinance is hereby declared to be
an emergency measure'. on the ground of urgent public need for
the preservation of peace, health, safety and property in the
City of Miami.
Section 6. The requirement of reading this Ordinance
on two separate days is hereby dispensed with by a vote of not
less than four -fifths, (4/5ths) of the members of the Commission.
