Section 1.. Chapter 54 of the Code of the City of
Miami is hereby amended as follows:, 1/
Sec. 54-34.1 - Requirements to repair, replace or
construct sidewalks curbsand gutters in new
Construction or' construction of $5',000.00 or. more
in value or exceeding 650 square feet or more in
area
(a) Whet Sidewalks and/or curbs and gutters shall be
constructed,' reconstructed or'repaired when any
private property located within the corporate limits
of the City of Miami is improved by the. construction,
reconstruction or repair of any type of structure of
$5,000.00 or more in value, or that when said building
.to be constructed or reconstructed is 650 square feet
or more in area, for which a building permit is
required.
(b) Tha# The tEw43pei eE4ie}ele Director of the Depart
ment of Public Works of the City of Miami, shall notify
the applicant for the building, permit that all side
walks and/or 'Curbs and gutters adjacent to the lot or
parcel to be improved shall be constructed, reconstruc-
ted or repaired; ti-ia' sidewalks and/or curbs and gutters
shall be constructed as provided in Chapter 54 of the
Code of the. City of Miami, as amended,; ghat in. the event
the surface of any,walk or„sidewalk and/or curb and
gutter is uneven, cracked or broken, these portions - of -
the sidewalk and/or curb and gutter shall be replaced.

certificates of occupancy until said sidewalks and/or
curbs and gutters are properly cornstructed,.reconstruct
ted or repaired as provided in subparagraphs (a) and
(b), above.
(d) tPha4 The E ty MaRage Director of the Department..
of public Works is hereby authorized to approve and
allow variations and deviations from the above require-
ments of repairing, replacing or constructing sidewalks
and/or curbs and gutters, as he determines necessary,
based on the conditions of the terrain and the
existing sidewalk and/or curb and gutter improvements
contiguous to the property involved, provided that
the property owner(s) furnish the City with a proper-
ly executed covenant in which the property owner(s)
agree(s) to pay the cost of the sidewalk and/or curb
and gutter construction when such construction is.
required by the City.
Section 2. This Ordinance, shall be deemed to be cumula-
tive and shall not repeal any other ordinance of the City of
Miami.
Section 3. In the event any section, paragraph, sentence,
clause or phrase of this Ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of
the remaining clauses, sentences, paragraphs, phrases or sections
of this Ordinance since the same would have been enacted by the
City Commission without the incorporation in this Ordinance of
any such unconstitutional clause, phrase, sentence, paragraph or
section.
Section 4. It is the intention of the City Commission,
and it is hereby ordained that theprovisions of this Ordinance
shall become and be made a part of the Code of the City of Miami,
Florida; that the sections of this Ordinance may be renumbered or
relottered to accomplish such intention; and that the
