A RESOLUTION ACCEPTING THE GRANT OF EASEMENT
OF APRIL 26, 1974 BY BAYVIEW ASSOCIATES, INC.
FOR CERTAIN PROPERTIES IN LOT A, BLOCK 1,
DUPONT PLAZA, AND AUTHORIZING AND DIRECTING THE PROPER
OFFICIALS OF THE CITY OF MIAMI TO RECORD SAID
GRANT OF EASEMENT IN THE PUBLIC RECORDS OF '
DADE COUNTY, FLORIDA,
WHEREAS, the property as hereinafter described
is a necessary segment of the Miami River Walkway; and
WHEREAS, Bayview Associates, Inc. has granted an
easement to the City of Miami for said purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA: •
Section 1. The grant of easement dated April 26th,
1974, by Bayview Associates, Inc. to the City of Miami,
attached hereto and made a part hereof, be and the same is
hereby accepted.
Section 2. The proper officials of the City of
Miami are hereby authorized and directed to record said
Grant of Easement in the Public Records of Dade County, Florida.
PASSED AND ADOPTED this 12 day of FEBRUARY
1975.

a corporation existing under the laws of the State of Florida, party
of the first part and the CITY OF MIAMI, a municipal corporation of
the State of Florida, party of the second part;
WHEREAS, the party of the first part is the Lessee under
a 99 Year Lease for the premises commonly known as the DUPONT
PLAZA CENTER, and
WHEREAS, the party of the second part is desirous of
obtaining an easement in a portion of said premises
WITNESSETH, that said party of the first part, for and in
consideration of the sum of One Dollar ($1.00) and other goods and
valuable considerations, to it in hand paid by said party of the
second part the receipt whereof is hereby acknowledged, does hereby
grant, give and convey to the party of the second part, its successors
and assigns, forever, an easement for the remaining term of its lease,
for the purpose of construction, laying and maintaining a walkway
through, over, across and under the surface of the following described
land, situated in the City of Miami, County of Dade and State of
Florida, to -wit:
A portion of Lot "A", Block 1, DUPONT PLAZA, as recorded
in Plat Book 50, at Page 11, of the Public Records of
Dade County, Florida, more particularly described as
follows:
Commence at a Point in the

Southwest along a circular curve having for its
elements a radius of 25 feet and a central angle of
20°21'10" an arc distance of 8,88 ft, to Point of
Beginning of the parcel of land hereinafter to be
described; thence continue along the aforesaid cir-
cular curve through a central angle of 69°38'05" an
arc distance of 30.38' to a point of tangency with the
East Right of Way boundary of Southeast Second Avenue;
thence runt South 02°19'22" East Along said East Right
of Way boundary of Southeast Second Avenue a distance
of 190 feet t') a point in the South face of a concrete
seawall; thence run South 89°19'12" East along said
South face of concrete seawall a distance of 16.32
feet to a point thence run North 02°19'12" West a
distance of 137.07 feet to a point; thence run South
87°40'48" West a distance of 8.6 feet to a point; thence
run itorth 02° 19' 12" West a distance of 21.72 feet to a
point; thence run North 87°40'48 " East a distance of 8.6
feet to a point; thence run North 02°19'12" West a distance
of 55.5 feet to the Point of Beginning. Containing 3195
square feet more or less.
IT IS UNDERSTOOD AND AGREED by and between the parties hereto that
THE CITY OF MIAMI, a municipal corporation agrees that the said
walkway to be constructed under and on the property hereto given
for such right shall always be maintained so as not to be or become
a nuisance.
IT IS FURTHER UNDERSTOOD AND AGREED by and between the parties
hereto that the GRANTOR shall continue to have access from the adjacent
water, across said easement, for lawful purposes.
IN CONSIDERATION of the granting of this easement, the Downtown
Development Authority of the City of Miami shall construct or cause
to be constructed (1) a landscaped pedestrian walkway on those lands
described on Page 1 hereof; (2) a permanent screen (poured concrete
and decorative concrete block) between the eastern easement line and
the DUPONT PLAZA PARKING GARAGE, in those areas which are now open,
and (3) all required alterations to the fire escape, adjacent to the
easement, which may be required to accomodate the proposed walkway
elevation, SHOULD the above easement be abandoned or discontinued by
operation of law or otherwise, the said easement shall cease and revert
to the GRANTOR herein, its successors or assigns.

Miami River Walkway Easement
So that the Miami River Walkway that is now being constructed
can be continued from the west side of S. E. 2nd Avenue bridge
to the Bayfront Park area, it was necessary to obtain several
pedestrian walkway easements. Bayvie.w Associates, Inc.,
owners of the Dupont Plaza Hotel, have agreed to grant a
walkway easement on their property.
It is recommended that the City Commission adopt the attached
resolution accepting this easement.
