A RESOLUTION AUTHORIZING THE DIRECTOR OF
FINANCE TO PAY TO MARGARET L. LEE,
WITHOUT THE ADMISSION OF LIABILITY, THE
SUM OF $139.00 IN FULL AND COMPLETE
SETTLEMENT OF ALL CLAIMS AND DEMANDS
AGAINST THE CITY OF MIAMI, UPON THE
EXECUTION OF A RELEASE RELEASING THE CITY
OF MIAMI FROM ALL CLAIMS'AND DEMANDS.
WHEREAS, Margaret L. Lee, an unmarried woman, filed
a claim against the City of Miami for damage incurred in
the amount of $139.00 on June 30, 1974, when she tripped and
fell on an alleged defect in the pedestrian crosswalk, at or
near 36 N.E. 1st Street, in the City of Miami; and
WHEREAS, this claim has been investigated by the office
of the City Attorney and said office recommends that this
claim be settled for the sum of $139.00;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the Director of Finance is hereby
authorized to pay to Margaret L. Lee without admission of
liability, the sum of $139.00 in full and complete settle-
ment of all claims and demands against the City of Miami,
upon the execution of a release releasing the City of "DOCUMENT

Miami from all claims and demands.
PASSED AND ADOPTED this 12 day of FEBRUARY ,
1975.

The following claims have been made against the City of Miami:
1. MARGARET L. LEE, an unmarried woman, allegedly tripped and
fell on June 30, 1974, in the pedestrian crosswalk at or
near 36 N.E. First Street in the City of Miami. She alleges
that she fell due to a protruding piece of concrete (appar-
ently a brick which had been paved over) and suffered per-
sonal injury with loss of wages. She submitted medical
bills of $39.00. After negotiation, Ms. Lee has agreed to
settle her claim for the sum of $139.00.
2. On April 17, 1974, a 1970 BSA Victor Special Motorcycle
belonging to JOSEPH SC11LC0, JR., was impounded by City of
Miami police officers as the result of erroneous informa-
tion which indicated that this was a stolen motorcycle
when in fact the said motorcycle was not stolen but was
the property of Joseph Scalco, Jr. and was properly in his
possession. Mr. Scalco has agreed to settle this claim if
he is reimbursed for the towing and storage charges amount-
ing to $19.50.
3. Claimant AMOS RAGANS owned an Iverson Bicycle, Serial No.
530752, which had been impounded by City of Miami police
officers on January 25, 1974. Mr. Ragans appeared at the
Police Station on February 4, 1974 to claim his property.
Upon attempting to return the bicycle, City police officers
discovered that the bicycle had been stolen from the City
bicycle impoundment pen. Mr. Ragan has submitted a purchase
receipt and has agreed to settle his claim for the value of
the bicycle amounting to $77.58.

4, EUGENE J. ZEMBRZUSKI filed a claim against the City of
Miami for personal injuries received on July 22, 1974, as
a result of a trip and fall on an allegedly defective City
sidewalk at or near N.E. 13th Terrace and N.E. Bayshore
Drive in the City of Miami, Mr, Zembrzuski is self-employed,
and incurred only medical bills for minor lotions, etc.
Fle treated himself by remaining at home and staying off
his sprained right foot and ankle, He originally claimed
loss of income amounting to $2.40.00, After negotiation, Mr,
Zembrzuski has agreed to settle his claim, for the sum of
$100.00.
5. ELIZABETH S. STEINBERG and JULIUS STEINBERG, her husband,
filed a claim against the City of Miami for personal injury
received by Mrs. Steinberg on June 21, 1974, as a result of
a trip and fall on an allegedly defective City sidewalk at
or near S.W. 22nd Terrace between S.W. 34th and 36th Avenues
in the City of Miami. Mrs. Steinberg submitted medical bills
amounting to $79.00 and also submitted color photographs
showing damage in the vicinity of her left eye, which required
a number of stitches. Mrs. Steinberg originally demanded the
sum of $750.00. After negotiations, both Mr. and Mrs. Stein-
berg have agreed to settle this claim for the sum of $329.00,
Based on the recommendation of Mr. Earle F. Perkins of this office,
I recommend that the above claims be settled for the sums indicated.
