A RESOLUTION ACCEPTING THE HIGHWAY RIGHT OF
WAY DEED EXECUTED BY OSCEOLA ENTERPRISES, INC.,
CONVEYING TO THE CITY OF MIAMI THE SOUTH 20
FEET OF LOTS 9 AND 10 OF CHARLES M. MUNDY'S
SUBDIVISION, AS RECORDED IN PLAT BOOK 3, AT PAGE
15, IN THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA;
AND AUTHORIZING AND DIRECTING THE PROPER OFFICIAL
OF THE CITY OF MIAMI TO RECORD SAID DEED IN THE
PUBLIC RECORDS OF DADE COUNTY, FLORIDA.
WHEREAS, Osceola Enterprises, Inc. has requested the
City of Miami to correct the drainage problem prevalent in
front of its property at 2829 Bird Avenue (Lots 9 and 10
of CHARLES M. MUNDY'S SUBDIVISION, as recorded in Plat Book 3,
at Page 15, in the Public Records of Dade County, Florida); and
WHEREAS, in the design of this improvement, the best
possible location for the construction of a drainage facility was
within the south 20 feet of this owner's property; and
WHEREAS, when informed that the City of Miami is
prevented by law from effecting any improvement on private
property, this owner agreed to dedicage the said 20-foot wide
stip to the City in an even exchange for the drainage installa-
tion, although the value of the dedicated land is estimated to
exceed the City's cost of this improvement; and
WHEREAS, in full accord, this owner executed and
delivered a Highway Right of Way Deed conveying to the City
of Miami the required 20-foot wide stip, containing an area of

WHEREAS, it is now in order for the City Commission

to accept the aforesaid Right of Way Deed and have it recorded
in the Public Records of Dade County, Florida;

Section 1• The Highway Right of Way Deed executed
by Osceola Enterprises, Inc., conveying to the City of Miami
the south 20 feet of Lots 9 and 10 of CHARLES M„ MUNDY'S
StiBDIVISION, as recorded in Plat Book 3, at Page 15, in the
Public Records of Dade County, Florida, be and the same is
hereby accepted.
Section 2. The proper official of the City of
Miami be and he is hereby authorized and directed to record
said Deed in the Public Records of Dade County, Florida.
PASSED AND ADOPTED this 12 day of FEBRUARY
1975.

The City investigated a request made by a property owner to correct
a drainage problem at 2829 Bird Avenue (Lots 9 and 10 of CHARLES M.
MUNDY'S SUBDIVISION, as recorded in Plat Book 3, at Page 15, in the
Public Records of Dade County, Florida).
The best possible location for the installation of a drainage facility
necessary to correct the problem was within the south 20 feet of the
aforesaid property.
When informed that the City of Miami is prevented by law from con-
structing a drainage structure on private property, the owner agreed
to dedicate the said 20-foot wide area to the City in an even ex-
change for the improvement, although the value of the dedicated land
is estimated to exceed the City's cost of this improvement.
In full accord, Osceola Enterprises, Inc. has executed and delivered
a Highway Right of Way Deed conveying to the City of Miami the re-
quired 20-foot wide strip containing an area of 2,000+ square feet.
It is now in order for the City Commission to accept the aforesaid
deed and to have it recorded in the Public Records of Dade County,
Florida.
THE DEPARTMENT OF PUBLIC WORKS RECOMMENDS THE ADOPTION OF THE RESOLU-
TION ACCEPTING THE HIGHWAY RIGHT OF WAY DEED EXECUTED BY OSCEOLA
ENTERPRISES, INC. CONVEYING FOR THE CONSTRUCTION OF A STORM DRAINAGE
INSTALLATION THE SOUTH 20 FEET OF LOTS 9 AND 10 OF CHARLES M. MUNDY'S
SUBDIVISION, AS RECORDED IN PLAT BOOK 3, AT PAGE 15, IN THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA; AND DIRECTING THE PROPER OFFICIAL
OF THE CITY OF MIAMI TO RECORD SAID DEED IN THE PUBLIC RECORDS OF
DADE COUNTY, FLORIDA.
