A RESOLUTION ACCEPTING THE COMPLETED CON-
STRUCTION OF MARKS BROTHERS COMPANY FOR
JEFFERSON HIGHWAY IMPROVEMENT H-4350 IN
JEFFERSON HIGHWAY IMPROVEMENT DISTRICT H-4350
AT A TOTAL COST OF $404,264.89: AUTHORIZING
AN INCREASE OF THE SCOPE OF THE CONTRACT IN
THE NET AMOUNT OF $4,199.89; AND FURTHER
AUTHORIZING AND DIRECTING THE CITY MANAGER
TO INSTRUCT THE PROPER OFFICIALS OF THE
CITY OF MIAMI TO MAKE A FINAL PAYMENT OF
$63,138.36.
WHEREAS, there exists a contract dated February 2,
1973 between the City of Miami and MARKS BROTHERS COMPANY; and
WHEREAS, the work has been satisfactorily completed
and Marks Brothers Company has furnished the required documents
certifying that all bills for labor and materials have been
paid in full in connection with the aforesaid contract; and
WHEREAS, due to sidewalk removal and replacement not
anticipated in the original contract there was an increase of
the scope of the contract in the net amount of $4,199.89; and
WHEREAS, a Public Hearing was held before the City
Commission on February 13, 1975 to hear any objections to the
completed improvements, and no objections were sustained; and
WHEREAS, the Department of Public Works recommends
that the completed work be accepted and final payment of
$63,138.36 be made to the Contractor;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSI

Section 1. The completed work performed by MARKS
BROTHERS COMPANY under contract dated February 2, 1973 for the
construction of JEFFERSON HIGHWAY IMPROVEMENT H-4350 in
JEFFERSON HIGHWAY IMPROVEMENT DISTRICT 9-4350 be, and is hereby,

REMARKS:
accepted at a total cost of $404,264.89.
Section 2. The scope of the contract be, and is
hereby, increased in the net amount of $4,199.89.
Section 3. The City Manager be, and he is hereby,
authorized and directed to instruct the proper officials of
the City of Miami to pay Marks Brothers Company a balance of
$63,138.36 as full and final payment for all work performed
and all materials furnished in connection with the contract
for JEFFERSON HIGHWAY IMPROVEMENT H-4350 in JEFFERSON HIGHWAY
IMPROVEMENT DISTRICT H-4350.
