HomeMy WebLinkAboutR-75-0098MEA/rr 1/23/75 RESOLUTION NO, /5-() A RESOLUTION GRANTING A "CONDITIONAL USE" AS PROVIDED IN ORDINANCE NO. 6871, ARTICLE XI, SECTION 1 (5)(b), TO PERMIT CONSTRUCTION OF DRIVE-IN TELLER FACILITY ON LOTS 1, 2 AND 3, BLOCK 1, SHENANDOAH (8-90), LOCATED AT 1698 S, W. 8TH STREET, IN CONJUNCTION WITH SOUTHEAST NATIONAL BANK OF CORAL WAY, LOCATED AT 1699 S. W. 22ND STREET, ZONED C=4 (GENERAL COMMER- CIAL) DISTRICT, SUBJECT TO THE FOLLOWING CONDITIONS: (1) RELOCATION OF THE PROPOSED FACILITY TO THE EAST AND REMOVAL OF ONE DRIVE --IN TELLER LANE. THE RE -DESIGN SHALL BE SUBJECT TO THE APPROVAL OF THE PLANNING DEPARTMENT; (2) THE APPLICANT SHALL FURNISH THE PROPER GOVERNMENTAL AGENCIES THE PROPER LEGAL DOCUMENTS RELEASING ANY AND ALL GOVERNMENTAL AGENCIES FROM SEVERANCE DAMAGES AND BUSINESS DAMAGES AT THE TIME THE WEST 60 FEET OF SAID PROPERTY IS TAKEN FOR RIGHT OF WAY PURPOSES. WHEREAS, the Miami Zoning Board, at its meeting of December 16, 1974, Item #9, following an advertised hearing, adopted Resolution No. ZB 211-74 by a 6 to 0 vote (one member abstained) denying Conditional Use as listed in Ordinance No. 6871, Article XI, Section 1 (5)(b), as hereinafter set forth; and WHEREAS, the applicant has appealed from the denial of the Zoning Board; and WHEREAS, notwithstanding the denial by the Zoning Board, the commission finds that the use will not be detrimental or injurious to the character of the development of the immedi- "DOCUMENT )P\DEX ITEM M O. f NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF ate neighborhood; THE CITY OF MIAMI, FLORIDA; Section 1, That the application for a conditional use as provided in Ordinance No. 6871, Article XI, Section 1 CITY COMMISSION MEETING OF JA N 9 1975 USOM ITa,a au......... W. 8th Street, in Conjunction with Southeast National Bank of Coral Way, located at 1699 Si Wi 22nd Street, Zoned C-4 (General Commercial) District, be and the same is hereby granted, subject to the following conditions: (1) Relocation of the proposed facility to the east and removal of one drive-in teller lane. The re -design shall be subject to the approval of the Planning Department; (2) The applicant shall furnish the proper governmental agencies the proper legal documents releasing any and all governmental agencies from severance damages and business damages at the time the west 60 feet of said property is taken for right of way purposes.
