Circuit Court No. 72"25003
(Resolution)
On December 27, 1972, the Plaintiff, Joseph Janji, filed suit
against the City of Miami and John Hanner, alleging that on
April 16, 1972 he was the object of excessive force causing
permanent injuries.
The evidence indicated that the Plaintiff suffered a fractured
skull and still has permanent injuries. The medical expenses
incurred to date are in excess of $450.00.
A recent deposition within the last 30 days indicates that the
Plaintiff is still suffering headaches. The minimum exposure
of the City of Miami is in excess of $12,000.00.
One of the eyeball witnesses on deposition t-:stified that the
police officer, since fired, struck the Plaintiff with his handcuffs.
Therefore, on the recommendation of Montague Rosenberg of the Torts
Division of the City of Miami Law Department, I recommend that this
case be settled in full and complete settlement for the sum of
$5,000.00.
