HomeMy WebLinkAboutR-75-0094RESOLUTION NO, 75=94 A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY TO JOSEPH JANJI, WITHOUT THE ADMISSION OF LIABILITY, THE SUM OF $5,000.00 IN FULL AND COMPLETE SETTLEMENT OF HIS CLAIMS AGAINST THE CITY OF MIAMI FOR ALLEGED PERSONAL INJURIES SUSTAINED BY HIM, UPON THE EXECUTION OF A RELEASE RELEASING THE CITY OF MIAMI FROM ALL CLAIMS AND DEMANDS. WHEREAS, the Plaintiff, JOSEPH JANJI, filed an action against the City of Miami and John Hanner, in the Circuit Court of Dade County, Florida, bearing Number 72-25003, alleging that he was the object of excessive force on or about April 16, 1972; and WHEREAS, after considerable negotiation, counsel for Plaintiff has agreed to accept the sum of $5,000.00 in full and complete settlement of the case; and WHEREAS, the City Attorney of the City of Miami has advised that it is in the best interest of the City of Miami to pay to JOSEPH JANJI the amount of $5,000.00 in full and complete settle- ment of the above claim; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: "DOCUMENT INDEX ITEM NO t" Section 1. That the Director of Finance is hereby authorized and directed to pay to JOSEPH JANJI, without admission of liability, the sum of $5,000.00 in full and complete settlement of his claim against the City of Miami for alleged personal injuries sustained by him, upon the execution of a Release releasing the City of Miami from all claims and demands, PASSED AND ADOPTED this 23 day of JANUARY , 1975. Circuit Court No. 72"25003 (Resolution) On December 27, 1972, the Plaintiff, Joseph Janji, filed suit against the City of Miami and John Hanner, alleging that on April 16, 1972 he was the object of excessive force causing permanent injuries. The evidence indicated that the Plaintiff suffered a fractured skull and still has permanent injuries. The medical expenses incurred to date are in excess of $450.00. A recent deposition within the last 30 days indicates that the Plaintiff is still suffering headaches. The minimum exposure of the City of Miami is in excess of $12,000.00. One of the eyeball witnesses on deposition t-:stified that the police officer, since fired, struck the Plaintiff with his handcuffs. Therefore, on the recommendation of Montague Rosenberg of the Torts Division of the City of Miami Law Department, I recommend that this case be settled in full and complete settlement for the sum of $5,000.00.
