WHEREAS, the Miami Zoning Board at its meeting of December 16, 1974, Item #8, following an advertised hearing, adopted Resolution No. ZB 210-74 by a 7 to 0 vote recommending approval as per Ordinance No. 6871, Article XIII, Section 4, for permission as hereinafter set forth; and WHEREAS, this Commission deems it advisable in the interest of the general welfare of the City of Miami to grant this permission requested on the ground that a refusal would result in practical difficulties and unnecessary hardship to the applicant under a C-1A (Planned Shopping Center) District; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF (42 Section 1. that the application for permission, as provided in Ordinance No. 6871, Article XIII, Section 4, to permit coffee shop addition to existing Shopping Plaza on Tract "A" Central Shopping Plaza (68-79), located at approximately 3805 N.W. 7th Street, Zoned C-1A (Planned Shopping Center) District, be and the same is hereby granted. Approval of the Center's revis master plan this year includes additional landscaping and par ing. Mr. Dean: All right, Staff? Mr. Dooney: The application tonight, is for the addition of a convenience use, a coffee shop in a C-1A Planned Shopping Center facility. C-1A plans were submitted to you, some months ago, for approval, and received subsequent approval from the City Commission. _ We find that with ample parking, and a beautification proposal, that as part of those plans, that the addition is appropriate, and recommend its approval, tonight. Mr. Dean: All right, will you state your name and address for the Record. Mr. Rodriguez: My name is Alfredo Rodriguez, and my address is 5843 Biscayne Boulevard. Mr. Dean: All right, did you hear the recommendation of Staff? Mr. Rodriguez: This - the only thing I can say is, that this particular coffee shop would - will be erected on an existing slab, and an existing deck. We request that some signatures from the neighbors, and we got around thirty-three signatures, from different neighbors, and - Mr. Dean: Did you understand what I said? Did you understand me? Mr. Rodriguez: Yes, I think so. Could you repeat the question? Mr. Dean: Did you hear the recommendation of Staff? fir. Rodriguez: Yes, I did. Mr. Dean: Do you agree with the recommendation? Mr. Rodriguez: Yes. Mr. Alfonso: I want to recognize the President of the Neighbor- hood, who always comes here. Mr. Dean: Do you have anything else to say? Mr, Rodriguez: No. Mr. Dean: All right, sir, do you want to say something? Mr. Alfonso; El Presidente. Mr. Andrea: My name is Jasper Andrea, and I'm one of the residents, within the area, I will put it that way, of Grapeland Heights. And the only thing that we've come across the information from our stores and merchants, and I heard that it was a cafeteria. Tonight, I find out it's a coffee shop. Because of this, and I know because I got that too. We have no objection, as far as I know. The only thing I do like to ask the question, that it does facilitate all eaters, not just one type of, you know, food, if it's goin' to be a coffee shop, in orther words, I have a feeling that I'd like to go in there, and be -35- December 16, 1974 Item #8 ' APPROXIMATELY 3805, N. Mr. Hodriguezt Yes. Mr. Alfonso: You also a menu there. Mr. Andrea: Yes, well, I was going to Mr. Alfonso: Do you understand what I on the menu. Mr. Andrea Traffic Shop, Is this location is. of the have baloney? They will have to have ask that, too. am saying, a variety : The other thing is, is it going to he next to the that wehre you're talking about? I don't know where There is only one store there, that I know of. Mr. Rodriguez: No, the location is going to be in the other end shopping center, it is going to be next to the Highway Patrol. Mr. Dean: Oh, I see. Mr. Andrea: You mean, in the back end of it? In the back side? Mr. Rodriguez: Right, it's going to be constructed only for the benefit of the people that will go to the Highway Patrol. It's not going to have an outlet to the shopping center. Mr. Andrea: Well, that's again, something that we didn't know. And that's why, that question, which didn't seem right to you. I was looking for a regular coffee shop, which we had no objection. Now, it's only an accommodation for the people who are hanging around, around the you know, the Highway Patrol. Mr. Rodriguez: It is not going to he for the people - Mr. Andrea: Didn't you say that - Mr. Gort: Wait a minute, let me get this right. Your question is, can the public go there, and buy. Right? Anybody from the neigh- forhood can go in there and buy? Mr. Andrea: Well, that's what I had in mind. Mr. Rodriguez: Everybody can go there and buy. The only thing is, the door opens next to the Highway Patrol, but it is a public place. Mr. Alfonso: The main intention is to give service to the Highway Patrol now, but remember about the menu, it has to be international. Mr. Andrea: Okay. I just wnat to say one more little thing. We have a coffee shop, which is in - right in the strip, on the regular shopping face. Now, this man - there's a Cuban Coffee Shop there, and this man cleans his utensils, in water, and dumps it right on the side- walk, right in front of his shop, and this is something we've seen, and there's a man here, which I have, to prove that. I hope that doesn't happen there, too, with you. Mr. Rodriguez: No. Mr. Andrea: Because, the facilities have got to be correct. And we don't have no objection to putting something there, nice, but don't use it as a slop house, in front of the public thoroughfare. I mean, if you can keep that in mind, and the Commission will see that you do, we have no objection, you go right ahead, and we will be your customers. Thank you very much. Mr. Romez; My name is Armando Romez, I am the owner of the Coffee Shop on 3809, 1 am inside of the shopping center, -36- Decenmber 16, 1974 Item #8 1 didn't khow, really, where they were to build that one, you know, it's on the back, beeause 1 did not whether it would be lust one door from thine, you know. 1 was wondering whether to keels the lease, two is impossible, ycu know. That is the only objection, really l have. 1 have One here, aihd their's there, 1 don't know if that will be all right. side. Mr. Dean He is going to be on the other side, way on the other Mr. Gomez: It will be outside, in a different place, I know. Mr. Dean: else to say? All right, Anyone else? Okay, do you have anything Mr. Rodriguez: No. Mr. Dean: Thank you very much. Now, we will close the public hearing, and have discussion among Board Members. Mrs. Basila. Mrs. Basila: Mr. Chairman. I move to grant. Reverend Johnson: Second. Mr. Dean: Mrs. Basila moved to grant, and seconded by Reverend Johnson. Under discussion? None. Call the roll. Mr. Simpson: The, motion on #8 is to recommend. One objection was received in the mail. Mrs. Basila offered the following resolution, and moved its adoption: RESOLUTION NO.
